Practical guide · Portuguese motor guarantee fund

Will the FGA pay for car damage caused by an unidentified vehicle?

Tiago Faria finds his car damaged in a parking area without knowing which vehicle caused it. In this fictional story, Clara Mota separates unidentified vehicles, lack of insurance and damage type. Finding the mark does not mean Portugal’s motor guarantee fund automatically pays for repairs; Tiago needs the car for work, but urgency does not replace the statutory conditions.

THE ESSENTIALS

Before you start

  • An unidentified vehicle and an uninsured vehicle are different situations.
  • Property damage caused by an unidentified vehicle requires a simultaneous entitlement to compensation for significant bodily injury.
  • A repair estimate does not prove every condition for FGA intervention.

The current rule changed in 2025

Article 49 of Decree-Law 291/2007, as amended in 2025, provides for bodily injury caused by unidentified vehicles or vehicles without valid, effective insurance. Property damage caused by an unidentified vehicle requires a simultaneous entitlement to compensation for significant bodily injury.

The statutory definition includes death, at least seven days in hospital, at least 60 days of absolute temporary incapacity or permanent partial incapacity of at least 15%. Application depends on the case; the claimant should not assign a clinical classification to an injury.

Compare two examples without deciding the claim

Fictional example A: Tiago finds his car scratched in a parking area, with no identified causing vehicle and nobody injured. Clara notes that the scratch and estimate do not establish the condition described for property damage caused by an unidentified vehicle.

Fictional example B: a collision involves an identified vehicle but there is doubt about its insurance. That requires a different initial question. Collect information that allows this to be checked rather than treating leaving the scene, unidentified and uninsured as interchangeable.

Record facts and preserve evidence

Note the date, place, what you observed, any vehicle details you could identify and available witnesses. Keep photographs obtained safely and any police incident reference. Separate what you saw yourself from what someone told you.

Urgent assistance takes priority when people are injured or danger exists. Do not try to produce a medical diagnosis, prolong an unsafe situation or assign liability merely to complete a report.

Do not confuse the conditions with proof of inability to pay

Article 49(4) does not permit the fund to add conditions beyond those in the chapter, such as requiring the injured party to prove that the responsible person cannot or will not pay. That does not remove the intervention requirements or establish accident liability.

Clara suggests asking for the basis of a requested item instead of assuming documents are unnecessary. Article 48 delimits the accidents and vehicles covered; this guide does not extend the FGA to every damage, place or vehicle.

Use the appropriate incident channel

Ask the FGA about submitting the request and the required information in light of the current regime and accident circumstances. An old FAQ or another person's outcome does not replace examination of the statutory conditions.

To review future protection, request a motor insurance quote from RMACHADO and explain which own-damage situations you want to compare. A new policy does not retrospectively resolve existing damage, which needs its own incident process.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Distinguish vehicle identification, insurance validity and damage type.
  • Gather facts, safe photographs and references.
  • Use the current regime and clarify the basis of items requested by the FGA.
  • Keep future protection and an existing incident separate.
