THE ESSENTIALS
Before you start
- Recovery means seeking amounts after an indemnity has been paid.
- The link between malfunction and accident matters to the inspection rule.
- The law qualifies acceptance without inspection evidence.
The date alone does not exhaust the rule
Article 27(1)(i) of Decree-Law 291/2007 links recovery for missed inspection renewal to an accident caused or worsened by vehicle malfunction. Article 17(2) prevents reliance on that ground if the insurer accepted the contract without inspection evidence, including for a later policy year. Individual facts need assessment.
Understand what is being requested
Recovery here means a demand to recover an indemnity already paid. It is different from choosing cover to repair your own car. If a demand arrives, identify the amount, stated grounds and relevant accident.
Clara suggests that Tiago put contract formation, documents supplied, inspection dates and the accident’s technical evidence into one timeline. Mark missing information rather than filling it from memory or a conclusion about fault.
Keep technical and contractual evidence
Retain communications, inspection records and actual reports on the vehicle’s condition. A repair quotation can list parts and costs without explaining accident causation. Ask which facts were observed and which conclusions are being put forward.
This preparation proves neither application of the statutory qualification nor absence of other liability grounds. For a payment demand, obtain appropriate help assessing its basis and responding within the applicable process deadline. Do not alter documents or treat a generic explanation as a completed legal assessment.
Regularise inspection and choose the appropriate channel
Keep inspection up to date. Insurance analysis does not replace lawful circulation requirements or vehicle safety. This guide authorises neither a journey with inspection outstanding nor calculation of an individual debt.
For an existing process, use policy support with the communication reference. To compare future protection, select Motor in Request a quotation. That enquiry neither resolves recovery proceedings nor creates retrospective cover.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Identify the accident, amount and stated grounds.
- Gather contract dates, evidence and inspection records.
- Separate technical condition, accident cause and own damage.
- Seek process support and keep inspection regularised.
