THE ESSENTIALS
Before you start
- A capitalisation operation and life insurance are different legal arrangements.
- Article 209 provides for succession to the position and continuation until maturity.
- Any early exit requires examination of the surrender terms.
First establish whether this is a capitalisation operation
Portugal's ASF explains that a capitalisation operation does not depend on an event concerning an insured person's death or survival. Its payment commitment relates to the contractual term and a financial or investment risk. This distinction matters before applying rules found in a life-insurance guide.
Marta looks for the legal designation in the conditions and title rather than relying on capitalisation in marketing material. If the documents describe capitalisation insurance, an insured person or death benefits, she asks for the relevant legal arrangement and clause. She does not change the classification to obtain a more convenient answer.
Death alone does not replace the maturity date
Article 209 of Portugal's Insurance Contract Act states that, on death, the subscriber's position passes to successors and the contract continues until maturity. This transfers the contractual position; it does not automatically turn death into an immediate death-benefit payment.
Fictional example: a title specifies maturity on 30 June 2030 and the subscriber dies in 2026. Article 209 does not permit replacing the 2030 date with the death date solely for that reason. Succession to the position must be addressed, while any contractual early-exit possibility needs separate examination. This example neither identifies successors nor calculates an inheritance division.
Retaining maturity does not mean every surrender is prohibited
Article 208 requires the conditions to identify, among other matters, duration, surrender values at contract anniversaries, surrender conditions, charges, title transfers and termination. The particular conditions must state the starting and ending dates and periodic payments where applicable. Those documents are needed to make an early-exit question specific.
Clara separates two answers: who occupies the subscriber's position, and what value and conditions surrender would involve on a given date. The first does not settle the second. Request dated contractual information about authority, procedure, charges and value without presenting it as a surrender instruction. Do not assume loss-free access to capital or the same tax treatment as another product.
Prepare the notification without confusing ownership and payment
As an organisational method, gather the contract and title identification, maturity date and applicable conditions reference. Ask the insurer what evidence of succession is required and how the contractual position will be recorded. Use its designated private channel rather than posting identity, death or estate documents in comments.

Succession and tax matters may require qualified professionals; this article neither chooses heirs, recommends an investment nor instructs anyone to retain or surrender it. Marta's useful distinction is between the effect of death and a later financial decision.
