Practical guide · Overlapping insurance

Family liability in your home policy and another policy: must you tell both insurers?

Yes, where the statutory multiple-insurance situation exists: the same risk, concerning the same interest and the same period, insured with several insurers. First compare the liability section in the home policy with the standalone contract. Similar names do not establish equivalent protection.

THE ESSENTIALS

Before you start

  • Compare people, risk, interest and period, not just the cover heading.
  • Actual overlapping insurance must be disclosed to the insurers.
  • Clarify differences before cancelling either policy.

The duty has a specific condition

Article 133 of Portugal's insurance contract regime requires informing all insurers on becoming aware of that multiple insurance and when reporting a claim.

Allianz Casa's February 2022 cover table lists private-life liability in certain modules. This illustrates inclusion within home insurance; it does not establish equivalence with a standalone liability policy.

Create a comparison that reveals differences

For each policy list insured people, liability situations, territory, dates and limits. Mark clauses that remain unclear. Liability arising from being a property owner should not be confused, merely because of a similar heading, with private-life liability.

Fictional Bairro Seguro example: Sofia Lobo finds two liability references in the family's documents. Clara Mota helps her compare the same scenario under both policies. Before adding sums insured or cancelling the apparent duplicate, Sofia wants to understand what would change. The answer may reveal an overlap, a difference or insufficient information.

Report an incident without duplicating the loss

If you know of another relevant contract, disclose its existence and reference through the appropriate channel. Ask how to report the incident and what each insurer needs. Do not present an expense already addressed elsewhere as a new one to obtain payment twice.

Keep one factual timeline and distinguish the case references. Communicate relevant developments without changing the account between insurers. This guide does not calculate compensation or decide which policy responds to a particular loss.

Review renewal with the comparison available

Ask for a written explanation of differences before deciding to retain, change or end a contract. Consider which people or situations would cease to be contemplated as well as any premium saving.

You can start an RMACHADO family-liability review or quote enquiry and explain that existing protection needs comparison. The enquiry neither cancels contracts nor establishes that one cover fully replaces another.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Collect policy references and compare people, situations, territory and dates.
  • Clarify whether the same risk and interest exist.
  • Disclose applicable overlapping insurance and developments.
  • Understand what changes before altering contracts.
