THE ESSENTIALS
Before you start
- Reporting facts does not mean promising a payment by the insurer.
- Follow the contract's notification deadlines and channel.
- A quotation or informal agreement does not confirm family liability cover.
What the contractual example asks of the insured
The October 2023 Allianz Vida Privada information calls for prompt written notification, within eight days of the event or knowledge of it, describing what happened. It warns against paying claimed compensation, making offers or committing the insurer without authorisation.
This is that product's example, not a statement that every contract has identical wording. Find your policy's channel, deadline and obligations. A useful opening question for support is: 'What steps should I follow before responding to the request for money I received?'
Separate the account of events from liability conclusions
Record the date, place, people involved, damaged property and what each person observed. Identify what is known and what remains unclear. Preserve any photos, invoices or quotation supplied by the neighbour without treating them as automatic confirmation of the amount owed.
Fictional example: during a visit, an object falls and damages a neighbour's property, leading to a €700 request. The family can report the facts and provide the quotation. This does not establish that the event is covered, that the family is legally liable or that the full quotation will be accepted.
Clarify the process before accepting a settlement
Ask the insurer for instructions on assessment and missing documents. If amounts have already been discussed, describe that conversation accurately in the notification. Do not promise payments on the insurer's behalf or present a claim reference as acceptance of cover.
Forward a judicial letter or notice immediately through the applicable procedure. Keep the receipt date and evidence of forwarding it to the relevant entity. Deadlines should not be ignored while attempting to resolve matters through informal messages between neighbours.
Organise support and future protection
For an event that has already happened, use the policy and claims support route and identify the existing contract. A new quotation does not create retrospective cover for that damage. To compare future protection, describe the household members and private-life situations you want assessed.
RMACHADO can help organise the request and documents for the insurer's assessment. Do not publish identifiable photos of neighbours, contact details or claim documents in a condominium group or on social media. Use a private channel and retain evidence of notification.
