THE ESSENTIALS
Before you start
- The name Fire does not by itself resolve every cause of a blaze.
- A special condition may address fire resulting from seismic phenomena.
- The extension's purchase, insured property and conditions need confirmation.
The example connects the exclusion to the fire's origin
In Generali Tranquilidade Multirrisco Casa conditions 465.031, July 2025, clause 3 excludes fire resulting from seismic phenomena from the base benefit in the specified situations. The Earthquake special condition on page 101 includes fire resulting from its listed phenomena. The preliminary clause requires purchased special conditions to be identified in the particular conditions.
This illustrates how clauses interact, subject to the remaining terms. It establishes neither that your building purchased the extension nor that every fire occurring after shaking was caused by it.
After an event does not necessarily mean caused by it
Fictional example: a building-management report records shaking felt in the morning and signs of fire found later. The sequence helps organise information, but does not allow the management alone to determine the cause.
Keep known timings, observed damage and information attributed to identified sources separate. Where the cause is not established, mark it unresolved. A notification should convey the available facts and documents, without adapting the account to fit a benefit.
Ask how the documents connect
For a preventive review, ask to see where the proposal identifies the extension and how it interacts with the exclusion you found. Identify the property considered in each document rather than treating a reference to common areas as an automatic answer for every unit and its contents.
Put the questions on one sheet: which base clause, which relevant exclusion, which special condition and where is evidence of purchase? If a reference cannot be found, leave it unresolved rather than replacing it with an interpretation of the product's commercial name.
Review before a claim requires an answer
RMACHADO can help prepare a Fire quotation or review using the building description and documentary questions. That work should distinguish what is already in the contract from what someone merely wishes to add.
Where there is immediate danger, people's safety and the authorities' instructions come first. This article is a preventive reading of terms, not permission to enter a damaged building, an expert finding on causation or confirmation of indemnity.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Find the exclusion for a fire's seismic origin.
- Check whether the special condition was actually purchased.
- Identify the relevant property, sums insured and excess.
- Record facts and questions without assigning an unestablished cause.
