A fire started in one unit: does that identify every loss and responsible party?

No. Where a fire started, where damage occurred and who is liable are different questions. In a building in Portugal, organise the account and affected property without turning an origin hypothesis into a conclusion about payment. People’s safety and the instructions of the authorities come first.

THE ESSENTIALS

Before you start

  • Prioritise safety and authorities’ instructions.
  • Separate known origin from hypotheses.
  • List affected locations and property.

Make two lists rather than one conclusion

Fictional example: after emergency services control a fire, the building administration receives reports of damage in a unit and a corridor. A resident suggests a possible starting point. The administrator records that account as unconfirmed and separates the affected locations without blaming an occupant.

In the first list, record observed facts and available official report references. In the second, identify apparently affected locations and property, separating observation from technical assessment. Do not enter unsafe areas to photograph or collect evidence; follow the instructions of the professionals and authorities present.

Separate private units and common parts

Article 1429 of the Portuguese Civil Code requires fire insurance for buildings under horizontal ownership, covering private units and common parts. Identify the affected areas separately. This rule does not by itself establish the cause of a fire, liability for damage or how each policy responds.

Ask the administration and intermediary to identify relevant processes and contracts. A corridor, door or installation may raise classification questions; record uncertainty rather than deciding from appearance. The objective is to route accurate information, not independently distribute costs between residents or assume how the ownership arrangements apply.

Do not confuse cause with a payment decision

When a technical finding about origin becomes available, retain its reference and distinguish it from informal messages. Identification of a starting point does not itself decide civil liability. The insurance assessment must consider the evidence and terms relevant to the corresponding process.

Keep requests and replies organised by process reference. If supplying an estimate, identify its location and work without treating its amount as approved. Do not assume insurance for one unit automatically resolves damage to another or to common areas. Equally, making one report does not close every outstanding question. Ask which information should be supplied to each process.

Choose contact according to the actual need

For an event that has already occurred, use the existing policy’s channels and building administration. To consider future protection in Portugal, read the Fire guide on rmachado.group and select Incêndio on the website. Do not present a new request as protection for previous damage. Avoid sharing identifiable people, addresses or neighbours’ documents in public comments.
