THE ESSENTIALS
Before you start
- Record policy delivery and identify the specific discrepancy.
- After 30 days, written or durable records still matter for documented discrepancies.
- Requesting correction and ending a contract are different decisions.
The 30 days relate to policy delivery
Article 35 of Portugal’s insurance contract regime provides that, once 30 days have passed since policy delivery without the policyholder raising a discrepancy between the agreement and policy, only divergences evidenced by a written document or another durable medium may be invoked.
It is incorrect to conclude that every opportunity to dispute a difference disappears afterwards. Nor should the period automatically be counted from the first consultation, card issue or premium payment. Identify delivery and seek appropriate help with uncertainty about the particular circumstances.
See the rule in a health contract
Article 11 of ASISA+Saúde Essencial W0010889 M-03-26 illustrates this correction and evidence rule. Read it alongside Article 35.
This does not recommend the product or establish that a condition Marta wanted was accepted. Distinguish the requested version, any response proposing changes and the agreement actually recorded.
Describe the difference using two references
As a preparation method, Marta records the reference of the received document and the passage she disputes. Beside it she identifies the communication or document recording what she understands was agreed. Saying that the price or protection seemed different is not enough to specify the issue.
Clara suggests a concrete question: what explains the difference and what correction is warranted by the documented agreement? Marta retains original files and messages, including dates, rather than editing a PDF to match her memory.
Request an answer without changing your intention
Raise the issue with the insurer through the appropriate channel and preserve evidence of the submission and response. Specify that you seek clarification or correction of a discrepancy; do not request cancellation if that is not your decision. An automatic acknowledgement confirms neither correction nor its effect.
If revised documents arrive, check whether they address the precise point raised and retain both versions. Seek appropriate support if the discrepancy persists. This guide neither calculates your individual deadline nor decides what evidence is sufficient in a dispute.
Protect data while clarifying the issue
Start with contract references and the question. Do not post policies, relatives’ details or medical information in comments. Send only what is necessary through the indicated private channel, without turning a clause review into unnecessary collection of health records.
At RMACHADO, use policy support for an existing contract. For a new need, select Health and request a quotation. That request does not itself correct the previous policy or replace an answer to the discrepancy.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Keep evidence of delivery and the policy version received.
- Identify the disputed clause and the record of the agreement.
- Request clarification or correction and preserve submission and response.
- Separate correction, cancellation and a new quotation, protecting personal data.
