Home insurance has paid: can I waive a claim against the responsible third party?

Sofia Lobo receives an insurance payment for damage at home and is then asked to declare that she will seek nothing further from the third party said to be responsible. In this fictional story, Clara Mota asks her to bring the wording into the claim review before signing. An insurance payment does not make a later agreement immaterial.

THE ESSENTIALS

Before you start

  • Payment may transfer rights against the responsible party to the insurer.
  • A waiver can affect rights that no longer depend solely on you.
  • Separate the insurance payment from losses still unrecovered.

Payment does not necessarily remove a third party's liability

Article 136(1) of Portugal's Insurance Contract Act provides that, after paying compensation, the insurer is subrogated to the insured's rights against the responsible third party to the extent of its payment. Here, subrogation means the insurer can exercise those rights within that amount. It does not make every person named in a claim automatically liable.

Sofia's question therefore does not end with having been paid. It is necessary to establish which damage was compensated, what right existed against a third party and which part the insurer may exercise. Establishing liability and assessing an actual agreement require the case's facts and documents.

A statement that nothing further is owed can have consequences

Paragraph 2 makes the policyholder or insured liable, up to the insurer's payment, for an act or omission prejudicing those rights. A waiver, broad release or agreement with the third party therefore needs consideration before signing. The document's existence alone does not establish a debt to the insurer: its scope and the prejudice to the rights must be examined.

As a practical method, Sofia identifies who proposed the wording, the incident and the losses it concerns. She asks the insurer whether it interferes with recovery of the payment and requests a response about that specific version. If the text involves concessions, a dispute or uncertain legal effects, she seeks legal advice before committing.

The part the insurer did not pay remains a separate issue

Paragraph 3 protects the insured's right relating to the uninsured part of the risk when competing with the insurer against the third party, subject to a contrary agreement in large-risk contracts. Partial subrogation does not justify treating every loss as fully compensated.

Fictional example: assume a loss of €3,000, of which the insurer paid €2,000. Sofia writes two lines: €2,000 paid and €1,000 requiring clarification. This does not establish that the third party owes €1,000 or determine priorities, costs or recovery outcomes. It helps avoid a declaration combining different portions without analysis.

Family relationships can change the recovery question

Paragraph 4 creates exceptions: paragraph 1 does not apply against the insured where legally responsible for the third party, or against a spouse, cohabiting partner, ascendants or descendants living in a common household with the insured, subject to the statutory qualifications concerning intentional liability or liability covered by insurance. The general rule is therefore not an automatic claim against relatives.

Clara helps Sofia gather the payment evidence, the breakdown of amounts and the complete wording received.
