THE ESSENTIALS
Before you start
- The effect differs at inception, renewal and during the policy year.
- Advance notice does not mean 30 extra days after the due date.
- A direct-debit mandate does not prove receipt of the premium.
At what stage was the premium left unpaid?
Article 61 of the insurance contract regime distinguishes three common situations. Failure to pay the initial premium or its first instalment by the due date automatically terminates the contract from its conclusion. Nonpayment of a subsequent annual premium or its first instalment prevents renewal. Nonpayment of an instalment within the policy year automatically terminates the contract on that instalment’s due date.
Rui therefore needs to identify the period to which the instalment belongs rather than treating every payment document alike. Adjustment premiums and additional premiums have their own rules in the same article. The date of a later message does not replace the relevant payment date.
These rules do not automatically carry over to life insurance: Article 58 excludes that branch from Articles 59–61. Having both policies linked to the same home does not make their treatment identical.
A payment notice is different from a new cancellation letter
During the contract, Article 60 generally requires written notice at least 30 days before the due date, stating the amount, payment method and place, and the consequences of nonpayment. This means 30 days before payment falls due, rather than a general grace period afterwards.
An exception exists for instalments at intervals of three months or less: where the contractual documents state the due dates, amounts and consequences, the insurer may dispense with that notice. It must then prove that the documents were issued, accepted and sent to the policyholder.
Clara helps Rui locate the notice and terms he received. Where documents or dates are disputed, he should request the supporting records and obtain appropriate assessment of his case. This article does not decide that a missing notice is irrelevant, or that being unable to find a letter is enough to confirm protection.
Direct debit: check actual collection
A direct-debit mandate permits collection to be attempted; by itself it does not show that the insurer received the premium. Article 56 connects the evidence provided by a receipt paid through direct debit with receipt of the amount by the insurer. Check the transaction and payment-document status, including any reversal, without publishing bank statements.
As a documentary example, Articles 12–15 of MAPFRE Casa terms34020241000 set out due dates, advance payment, notice and nonpayment. The relevant text was read on pages 22–23 of the document linked from the product page. This shows where such rules may be found in a policy; it neither recommends the product nor replaces your own contractual terms.

Paying later does not confirm retrospective cover
Request written confirmation of the contract’s status, the payment concerned and the dates applied before assuming that a late payment reinstated protection. The regime contains specific mechanisms, including payment by an interested third party whose rights are reserved in the contract under Article 55; their conditions do not amount to a general grace period for every policyholder.
For an existing policy, use policy support and send documents only through the indicated channel. For a comparison of future protection, select Home in the RMACHADO request. A request or new quotation does not reinstate the previous contract or confirm cover for damage that has already occurred.
