Beneficiary clause guide · Life insurance beneficiaries

The beneficiary died before the insured person: who receives the life benefit?

Henrique Vasconcelos is still alive, but the person he named as sole beneficiary has died. In this fictional story, Clara Mota asks for the full clause before answering whether that person’s family receives the benefit. This concerns an individual designation in life insurance payable on death; it is not a payment request triggered by the beneficiary’s death.

THE ESSENTIALS

Before you start

  • Start with the current wording and the order of deaths.
  • Check whether the right to revoke the designation was waived.
  • Do not allocate a benefit based only on family relationships.

The default rule distinguishes two situations

Unless otherwise stipulated, Article 198(2) of Portugal’s Insurance Contract Act directs the capital, on the insured person’s death, to that person’s heirs if the beneficiary died first. Where the right to revoke the designation was waived, it directs it to the beneficiary’s heirs.

Predeceasing means dying before the other person. Henrique separates two dates and two roles. The name of whoever paid the premium or an informal list of relatives does not answer those questions. Start with the applicable clause.

Do not skip the question about a waiver

Clara asks Henrique to locate the designation, subsequent declarations and references to whether it can be changed. If he finds wording he does not understand, he copies his question into the enquiry without rewriting the document.

Do not treat a spoken assurance that “it now goes to the children” as a conclusion about entitlement. Ask the reply to identify the clause and explain the circumstances considered. This guide does not choose successors or resolve a dispute between heirs.

Define the circumstances you want clarified

The example starts with one individually named beneficiary. If the policy names several people, uses generic descriptions or concerns survival benefits, provide that wording for its own assessment. Do not automatically apply this example’s answer to a different structure.

Henrique keeps a complete copy and writes down his question: does he want clarification of the existing clause or consideration of a future amendment? Those are different tasks. He does not sign amendments, waive rights or cancel a policy because he has read an isolated rule.

Prepare a private enquiry and a verifiable reply

Give the policy reference and ask which information is actually required. Identity documents, certificates and financial details do not belong in public comments or group messages. Use the private channel indicated and retain the response with the document reviewed.

For an existing policy, use Policy support and claims. To prepare future protection, select Life under Request a quotation. An enquiry does not confirm recipients or payments or amend a designation. Clara leaves four checks for the next conversation.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Obtain the current clause and amendments.
  • Separate insured person, beneficiary and the order of deaths.
  • Ask about any waiver of revocation and the applicable wording.
  • Retain the reply and seek legal assessment where rights are disputed.
