THE ESSENTIALS
Before you start
- Locate the current policy.
- Check the designation.
- Separate policy and estate inventory.
There is a relevant legal distinction
In its judgment of 10 January 2017, case 2303/12.2YXLSB-B.L1.S1, the Supreme Court considered a contract with a mutual association. It distinguished capital due directly to beneficiaries from the subscriber’s contributions relevant to the estate inventory. It did not decide that every life benefit is always outside inheritance questions.
Keep the two tasks identifiable
D. Graça neither automatically adds the capital to an informal division nor removes it based on a rule read out of context. With Clara, she asks for confirmation of the designation and procedure. If entitlement is disputed, she separates contractual clarification from the legal advice needed to resolve the disagreement.
Establish facts before allocating money
Keep the policy, any beneficiary amendments and the insurer’s answer. An old note in family paperwork may not reflect the current designation. Avoid promising amounts or shares before confirmation. Read RMACHADO GROUP’s life guide to organise the contractual information that can support discussions with the appropriate professionals when individual entitlement needs examination.
