The life insurance policyholder died: who takes over the contract?

Sofia Lobo sees that Rui is the policyholder and she is the insured person. In this fictional story, she asks what would happen to the contract if Rui died. Clara Mota separates possible transfer of the contractual position from payment following an insured person's death: they are different questions.

THE ESSENTIALS

Before you start

  • Identify the policyholder, insured person and beneficiaries.
  • Read the transfer clause and check the policy version.
  • Confirm authority, consents and formalities in writing.

The deceased person's role changes the question

The policyholder is the party entering into the contract. The insured person is the person whose life is covered. They may be the same person, but Article 183 of the Portuguese Insurance Contract Act links life insurance to the insured person's death or survival. A policyholder's death, where that person is not insured, should therefore not automatically be treated as the event triggering a death benefit.

Sofia first checks each participant's role in the particular conditions. If the deceased was also insured, assessment of any claim and remaining benefits requires its own analysis. This guide determines neither payment nor continuation of individual benefits.

The law directs attention to the contract

Article 96(1) allows the contract to provide for the deceased policyholder's position to pass to the insured or an interested third party. This wording does not automatically select a spouse, all heirs or whoever starts paying the premium. Locate the contractual provision and check its requirements.

Paragraph 2 qualifies the rule for contracts concluded in consideration of the policyholder personally and order or bearer policies. Article 182 does not permit those two policy forms in personal insurance. For life insurance, Article 187(1)(e) requires the policy to state, where applicable, conditions for continuation by beneficiaries on death, or by heirs. Clara asks for the full clause; inheritance questions may require legal advice.

An example shows why the requirements matter

Clause 16 of Allianz Vida Crédito 1904–10/2026_01 allows the beneficiary to take the deceased policyholder's place, subject to insured persons' consent, written communication and recording in the particular conditions. This is a contractual example, not a recommendation or an automatic rule for other policies.

The library lists this version as applicable from 29 October 2026. That does not establish that it governs Sofia's policy. She checks her documents' reference and asks the insurer to identify the applicable clause. Publication of a new PDF does not establish that an earlier policy was amended.

Prepare a request about the contractual position

As an organisational method, identify the policy, the former policyholder, who remains insured and who wishes to take over the position. Ask which consents, evidence and formalities are necessary, who may communicate and how the change will be documented. Also request instructions about outstanding premiums; do not assume that death automatically suspends obligations.

Keep the response and check any documents issued. Simply paying from another account does not prove transfer. For an existing policy, use RMACHADO policy support and the indicated confidential document channel. To compare future protection, select Life under Request a quote; that request neither transfers nor activates a contract.
