THE ESSENTIALS
Before you start
- Paying the premium does not, by itself, identify the insured person or beneficiary.
- Check the relevant roles in the contract documents.
- Article 43 requires the insured person’s consent in its specified situation, subject to statutory exceptions.
Start with roles, rather than the account paying the premium
The policyholder enters the contract and assumes the obligations assigned to that role; the insured person is the person whose life or personal situation the cover concerns; the beneficiary receives the benefit under the agreed conditions. One person can occupy several roles, but that coincidence should not be assumed. MetLife’s public explanation distinguishes these life-insurance roles.
In the fictional example, Sofia only wants to check the structure of a proposal naming Rui as the insured person. She asks where each role appears and which event relates to each benefit. She does not conclude that paying monthly premiums makes her the insured person or the recipient of a capital payment.
Insurable interest and consent are separate questions
Article 43 of Portugal’s Insurance Contract Law requires a legally protectable interest in the covered risk. For life insurance, paragraph 3 additionally requires consent to cover the risk from an insured person who is not a beneficiary. It provides an exception for a contract resulting from a statutory provision or a collective labour-regulation instrument.
Do not reduce this to “the payer may insure someone else without involving them”, or to a universal requirement detached from those conditions and exceptions. Ask which parties and consents are necessary for the specific arrangement. Do not sign for another person or treat a payment as a substitute for their participation in the process.
Check the structure in the proposal and policy
Article 37 specifies policy contents, including identification of the parties and, where appropriate, the insured and beneficiary, risks, rights and obligations, sums insured and commencement. Read these together to understand who is protected. A collection receipt answers a question about payment, rather than every question about the contract’s scope.
Sofia and Clara record the named policyholder, insured person and beneficiary clause without selecting recipients for anyone. If the summary and documents differ, they retain the versions and request clarification. Acknowledgement of a correction request is different from confirmation of a contractual amendment.
For a mortgage, connect the people with the purpose
For mortgage-related insurance, also identify the debt to protect, the insured person or people, and the intended destination of each benefit. Do not assume that the paying-account holder, every borrower and the beneficiary are necessarily the same person, or that everyone has the same share of cover. Those answers require the applicable proposal.
To prepare a future comparison, select Life in Request a quote and say you want to clarify the contract’s roles and mortgage-related protection. Use policy support with its reference to review an existing policy. Do not post beneficiary names, medical details or third-party records in comments. A request neither activates nor changes insurance.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Identify policyholder, insured person and beneficiary separately.
- Check risks, amounts and dates in the proposal and policy.
- Ask about applicable consents without replacing another person’s participation.
- Clarify discrepancies through the proper channel before assuming cover.
