THE ESSENTIALS
Before you start
- Life insurance has its own non-payment rules.
- The reinstatement deadline belongs in the policy; there is no universal number of days here.
- A late transfer does not itself confirm reinstatement or the protected period.
First establish what happened to the policy
Article 58 of Portugal’s Insurance Contract Law excludes automatic application of articles 59–61 to life insurance, unless compatible contractual terms provide otherwise. Do not transfer the home policy’s automatic-termination rule to life insurance simply because both relate to the same mortgage.
Under article 203, non-payment may entitle the insurer, according to the circumstances and agreed terms, to terminate with the resulting compulsory surrender, reduce the policy or convert it into a premium-free contract. This does not mean every life policy has a surrender value. Ask which consequence was applied and which clause supports it.
Reinstatement without a new exam has a contractual deadline
Article 203(2) requires policy terms to state the maximum period for exercising the right to reinstate a reduced or terminated policy on its original terms without another medical examination. The period runs from the reduction or termination date. Article 187 also includes this deadline among the policy information, where applicable.
Clara helps Rui locate three items: the reduction or termination date, the stated deadline and the procedure for exercising the right. Do not replace that date with the day you noticed the failed debit. If the deadline has passed, ask about alternatives and their requirements; do not assume reinstatement on the earlier terms remains available.
An irrevocable beneficiary calls for another check
If a third party has an irrevocable benefit, article 204 requires the insurer to notify that beneficiary within 30 days so that they may pay instead of the policyholder. Without that notice, the insurer cannot invoke the agreed non-payment consequences against that beneficiary. This is a specific beneficiary protection, rather than a general 30-day grace period for every policy.
If a bank appears as beneficiary, check the nature of the designation and the communications instead of assuming any reference to the bank makes the benefit irrevocable. This assessment does not authorise stopping mortgage instalments.
Ask for dates and a written answer before relying on protection
Rui gathers the premium notice, the communication received and the reinstatement clause. Clara suggests asking for an answer identifying the amount, procedure, policy status and effective dates. A late payment or debit mandate does not establish the outcome or confirm protection for an event that occurred in the meantime.
For an existing policy, use RMACHADO’s Policy support and claims route. To compare future protection, choose Life insurance under Request a quote. A quote request does not reinstate the previous policy, settle a claim or guarantee acceptance. Do not send medical reports with the initial enquiry.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Identify the premium and the status communicated by the insurer.
- Find the reduction or termination date and reinstatement deadline.
- Check any irrevocable beneficiary and the required notices.
- Keep the answer stating the procedure, amount and effective dates.
