A product may cause harm: is withdrawing batches the same as compensating third parties?

Henrique Vasconcelos receives a technical alert about the fixings of a batch of household stools sold by his company. In this fictional story, he asks Clara Mota whether recovering the units to prevent an injury is liability compensation. Clara starts with the purpose of the operation: preventing harm and compensating for harm already caused raise different questions.

THE ESSENTIALS

Before you start

  • A safety risk may call for action before anyone claims compensation for damage.
  • The duty to act does not establish that insurance pays for the operation.
  • An express withdrawal extension must be checked in the policy terms.

Product safety has its own process

The official Your Europe page, checked by its European editor on 19 August 2026, explains that manufacturers and other businesses involved in distribution or sale must take measures when they consider a product unsafe, to prevent accidents, and report through the stated process. It addresses non-food products; food and medicines have separate systems.

Henrique does not turn an insurance discussion into a technical assessment of the stools. He refers the alert to those able to assess safety and the applicable duties. Clara helps him distinguish safety instructions from the financial question. The insurance assessment should proceed without delaying a required protective measure or notification to the authorities.

Liability insurance starts with the obligation to compensate

Article 137 of Portugal's Insurance Contract Framework defines liability insurance by the risk of an obligation to compensate third parties. An invoice for an operation organised by the company to recover units that may still be dangerous should not, for that reason alone, be treated as compensation for an injury.

In the story, Henrique must decide what to do about the batch before knowing whether there will be an injured party. Logistics costs may already arise at that stage. If a damage claim follows, it requires a separate assessment with its own facts and records. The absence of a claim neither makes the technical alert irrelevant nor establishes that withdrawal cover responds.

Policy wording shows why the extension must be express

In Caravela's Non-compulsory Liability terms, version 4/September 2023, Special Condition 51 addresses third-party damage after delivery. Clause 3(e) allows withdrawal expenses borne by the insured or third parties when expressly provided in the policy schedule. Repair and replacement appear in other subparagraphs. This is a contractual example, without recommendation, subject to the remaining terms; it does not establish inclusion in Henrique's policy.

Clara does not write “recall included” merely because the policy says Product Liability. She asks for the agreed provision addressing the described operation. The reading should clarify the event allowing the cost to be submitted, the products and period considered, the limits and the applicable procedure. If the available information does not answer these points, the question remains open.

From undispatched stock to units in consumers' homes

In a preliminary plan, Henrique identifies the units still under the company's control and those delivered to distributors or consumers. Stopping new shipments does not recover units already sold. Clara asks him to describe these stages so that the question about expenses corresponds to the operation actually planned.

If a logistics provider quotes a combined price for communications, collection, transport and storage, Henrique asks for an itemised account of the tasks. He records who instructed them, the technical reason and amounts already incurred. A safety instruction explains the need to act; the insurer's decision assesses a different question about the contract. Assessing one cost does not confirm the others and should not delay required protection.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Refer the safety risk through the applicable technical and legal process without waiting for the insurance decision.
  • Find the express provision for withdrawal costs in the policy and identify its version.
  • Itemise the operation, units, instructions and costs, distinguishing an estimate from expenditure.
  • Notify the insurer and retain the specific response without treating it as safety authorisation.
