A leak discovered today, earlier warning signs: what should you tell the business insurer?

Nuno Patrício discovers signs of a leak and does not know how long the problem has existed. Clara Mota asks him to separate discovery, maintenance records and what was already known. This fictional story determines no environmental liability and anticipates no coverage decision.

THE ESSENTIALS

Before you start

  • Discovery today does not establish that the cause began today.
  • Prior knowledge and maintenance may matter under the policy.
  • Keep facts, records and uncertainties on separate lines.

Start with what you can date

Build a timeline of the first observed sign, available reports, maintenance work and notification of the problem. If a technician identifies a probable origin, label it as a technical assessment and keep the record. Do not turn an estimate into an observed date.

Nuno finds a record of earlier work, but it does not establish the cause of the current leak on its own. Clara helps collect the references and mark what remains uncertain rather than fill the gap with a convenient date.

Read maintenance and knowledge conditions

Ageas Ecosfera pre-contractual information A1596, edition 03/2022, excludes damage resulting from poor condition or defective maintenance where the insured knew or could not reasonably have been unaware of that condition before the damage. It also identifies liability-generating events known when taking out the policy. These are conditions of that document, not an automatic rejection of every old leak.

Ask for the clauses applicable to your policy and the link between each condition and the documented facts. Finding a sign now does not determine what was known earlier or replace assessment of the installation's operation and maintenance.

Separate the technical response from the insurance discussion

APA explains that where an economic activity causes environmental damage or an imminent threat, the operator must take the necessary preventive and remedial measures.

Follow the safety, technical and reporting procedures applicable to the occurrence with competent support. Record who assessed it, which measures were indicated and when they were carried out. Comparing insurance quotations does not replace that response or decide the activity's environmental classification.

Use the appropriate process

If there is a policy and an occurrence has already been identified, use that policy's claims or support channel. Provide the timeline, available records and unresolved questions through the indicated process. Do not post plans, operational reports or third-party information on social media.

For future protection, RMACHADO can help organise a Business Liability quotation and questions about environmental arrangements. Identify already-known signs or occurrences: a new quotation should not be presented as confirmation of retrospective protection.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Date observations, maintenance and communications without inventing the origin.
  • Distinguish facts, technical assessments and unresolved matters.
  • Locate maintenance and prior-knowledge clauses.
  • Use the appropriate technical, administrative and insurance channels.
