THE ESSENTIALS
Before you start
- Article 41 mentions rent insurance without automatically equating all home policies.
- Identifying a paid expense does not itself establish tax eligibility.
- Historical guidance on one case must be distinguished from assessing the current year and contract.
First identify the income and expense
In the text currently displayed by Portugal’s tax authority, CIRS article 41(1) provides, for each building or part, for expenses actually borne and paid to obtain or secure property income, including rent insurance, subject to the listed exclusions. Paragraph 9 requires documentary evidence. This guide addresses the question within category F.
That tax wording does not mean labelling an expense “home insurance” is enough to deduct it. Establish what the policy covers and which property and expense it concerns. A deduction from income is also not repayment of the premium or a guaranteed IRS refund.
A 2017 answer illustrates the distinction
In binding information for case 1115/2017, approved on 5 December 2017, the tax authority specifically considered home multi-risk insurance. In that answer, it distinguished compulsory and optional insurance and did not accept the described optional multi-risk expense as eligible. The statutory reference to rent insurance therefore does not prove deductibility of every multi-risk package.
The document is historical and answers its described situation. We do not present it as a new 2026 rule or a decision on every current policy. Check the contract and tax year against the applicable framework and seek clarification from the tax authority or a qualified professional before declaring a doubtful amount.
Gather documents that answer the actual question
Clara suggests gathering the policy reference, available breakdown of cover and premium, property identification, premium receipt and payment evidence. If a document covers several properties or components, flag that; do not choose an arbitrary allocation to reach a desired figure.
A useful tax-validation question is whether this identified component, paid in this year and linked to this rented property, meets category F requirements. Keep originals and the answer. Do not publish policies, rent receipts, tenant details or bank statements in social-media comments.
Compare protection before subtracting a tax advantage
D. Graça keeps two budget lines: the actual insurance expense and any tax treatment still requiring validation. Clara helps compare risks, exclusions, sums insured and costs without converting an expected tax result into a commercial discount. The usefulness of protection and deductibility are not settled by the same label.
