CIF or CIP: does seller-paid insurance provide the same protection?

Henrique Vasconcelos receives a commercial offer including carriage and insurance. In this fictional story, Clara Mota asks which Incoterms rule, edition and destination it names. ‘The seller pays for insurance’ is not enough to compare the protection of the goods.

THE ESSENTIALS

Before you start

  • The commercial obligation and insurance policy are different documents.
  • CIF and CIP use different cover references in the 2020 edition.
  • Paying for carriage does not, by itself, determine when risk passes to the buyer.

Start with the rule and edition

The ICC’s official introduction to Incoterms 2020 retains Institute Cargo Clauses (C) as the CIF default and refers to Clauses (A) for CIP. Different agreements are possible. Broader cover remains subject to exclusions; it does not mean every loss is paid.

Copy the full reference from the sales contract: rule, place or port, and edition. If the order, invoice and carriage proposal use different references, seek clarification before treating them as equivalent. This article does not select the appropriate trade rule for your transaction.

Separate the sales contract from the insurance

ICC explains that Incoterms govern aspects of a sale when incorporated in that contract. They do not automatically bind an insurer to the requirements between seller and buyer: the policy follows the terms agreed when purchasing insurance.

Henrique therefore asks for the insurance document rather than merely ‘insurance included’. As a comparison method, Clara creates entries for the goods, route, value, protected interest, limits and exclusions. A gap in an entry remains a question; it is not filled by inference from the sales price.

Destination and risk transfer are different questions

In the CIP example described by ICC Academy, the seller pays carriage and insurance to the named destination, but risk passes to the buyer when goods are delivered to the carrier at the applicable point. The destination should not be confused with that delivery point.

In the story, Henrique asks for the actual places to be identified in the documents and for an explanation of how insurance follows the agreed journey. Damaged goods may affect the business, but paying freight does not settle the insurance assessment or every participant’s liability.

Compare the actual route before dispatch

List planned legs, carriers and relevant operations, including any transhipment or storage. Compare that description with the application and insurance document. Do not assume an undescribed need has been accepted merely because a certificate exists.

For a cargo quotation, tell RMACHADO the type of goods and route to assess. Detailed commercial documents use the appropriate channel. If a loss has already occurred, use the claims process and preserve original evidence; a new quotation does not retrospectively alter the shipment’s protection.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Identify the rule, edition and place or port in the commercial documents.
  • Obtain the insurance document and compare its protection with the agreed obligation.
  • Separate who pays carriage, the risk-transfer point and the destination.
  • Describe the actual route and clarify gaps before dispatch without assuming acceptance.
