Practical guide · New replacement value and reinstatement

New replacement value: can I choose not to replace damaged business equipment?

Henrique Vasconcelos reviews protection for industrial equipment and considers whether, after damage, he would prefer to stop using it. In this fictional story, he asks Clara Mota whether 'new replacement value' guarantees the same payment basis without repair or replacement. The extension's benefit must be considered alongside the business decision.

THE ESSENTIALS

Before you start

  • New replacement value may depend on actual reinstatement.
  • Notifying an intention and completing the work are different requirements.
  • The extension has its own conditions; the remaining contract needs separate assessment.

The benefit may depend on repair or replacement

In MAPFRE Multirriscos Empresas wording 34820200900, particular clause 04 for industrial equipment becomes ineffective if the insured cannot or does not wish to replace or repair the damaged property. It should not be read as promising new replacement value regardless of what happens to the equipment.

This is a specific example requiring express agreement and identified, valued property. If Henrique considers ending that use, he asks how the decision affects the extension and the calculation under the policy's remaining rules. Clara neither determines the payment nor recommends buying equipment to satisfy the clause.

Check the requirements before relying on the label

Particular clause 04 requires an age of no more than 10 years, counted from 31 December of the manufacturing year, and a capital-updating clause in the policy. Its exclusions include obsolete, useless or out-of-use equipment. These are this wording's conditions, rather than a universal market age limit.

Henrique gathers the manufacturing year and technical identity without replacing an unknown fact with the purchase date. He asks which clause was actually agreed and which property it applies to. An insured-sum entry based on new value does not remove the other requirements.

Two deadlines serve different purposes

In this example, the intention to replace or repair must be notified within 6 months of the damage, or another period granted in writing. Work must proceed reasonably promptly and finish within 12 months; an extension requires written permission during those 12 months. Notifying an intention does not prove reinstatement is complete.

If completion does not meet the stated terms, the clause limits payment to what would have resulted without it. Henrique records notification, response, start and completion separately. He does not treat a deadline's final day as an instruction to delay contact or repairs; if he anticipates difficulty, he raises it with the claim handlers.

Compare the equivalent property and limits too

The clause limits replacement to property of the same quality or type, without greater scope than the insured property when new, within item and overall insured sums. It allows another location or position without increasing liability for that reason. These rules do not approve an upgrade or automatically establish future cover for other equipment.

For an existing loss, use Support and claims and ask for the extension to be distinguished from the remaining valuation rules. To compare future protection, select Business multirisk in RMACHADO's 'Request a quote' and describe the continuity or change needed. Any payment and the replacement property's cover still require their own confirmation.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Find the agreed extension and identify the equipment it applies to.
  • Check manufacture, contractual age, capital updating and exclusions.
  • Separate notification of intent from actual completion, with written permissions.
  • Ask what non-reinstatement means and how the remaining contract rules apply.
