Using subcontractors: who does what in a liability request?

The customer knows your business name, but several entities may contribute to the service. Before requesting liability terms, describe the work chain. A map of roles is more useful than saying the company handles everything.

THE ESSENTIALS

Before you start

  • Identify each role.
  • Separate entities and stages.
  • Flag unknown information.

Map three stages of the service

Identify who agrees the work, who performs it and who delivers it. Add the supplier of materials, equipment or site access where relevant. The map describes operations; it is not a legal allocation of liability.

Fidelidade’s documentation is organised by activities and professional areas. This gives a practical reason to identify the actual work before requesting terms, rather than assume a broad label answers every question about the participants.

An example with distinct roles

Fictional example: Inês’s business coordinates a service while an independent contractor performs a specialist task. Rui organises delivery to the customer. They record the roles without claiming that one entity is automatically covered by another’s insurance.

They flag stages they do not yet understand and locate relevant records. Where the contractual relationship changed, they distinguish the current agreement from an older version. They do not indiscriminately circulate full contracts in a group conversation.

Use the map when considering terms

Ask how the proposal identifies the activity, covered persons or entities and situations involving third-party services. Request clarification of scope, limits and exclusions for the particular case without assuming inclusion or exclusion.

Keep the answer with the version considered. A contractor’s certificate is not a substitute for reading its scope. Visit Business Liability on rmachado.group to prepare the request, using the indicated channel for necessary documents.

KEEP THESE QUESTIONS
