THE ESSENTIALS
Before you start
- The law provides for an extension to items of people living with the insured in a shared household, unless otherwise agreed.
- An item may still be excluded for another contractual reason.
- Ownership and proof that an item belongs to the insured collection are different questions.
A rule for a collection of items, with conditions and qualifications
Article 125(2) of Portugal’s Insurance Contract Law provides that, for insurance of a collection of items and unless otherwise agreed, insurance extends to items belonging to people living with the insured in a shared household at the time of the loss. The same paragraph also refers to items belonging to the insured’s workers. In each case, the property must not be excluded from the insured collection for another reason.
The rule does not mean that only items bought by the person named in the policy can be considered. Nor does it mean that all property of relatives, workers or visitors is always covered. The type of insurance, the relevant relationship at the time of the incident, the agreement and applicable exclusions need to be checked.
Belonging to someone in the household does not make every item covered contents
Sofia identifies the camera as Rui’s property and describes their shared household. Clara then checks the definition of contents, property categories, the insured location and any specific conditions. The ownership extension does not remove an exclusion for another reason or create cover for an uncontracted risk.
Do not transfer the answer about Rui’s own item to equipment owned by his employer or an object left by a visitor. Those situations require their own identification. A name on an invoice may be relevant evidence to clarify, but it should not replace the assessment of ownership and policy terms.
Who proves inclusion, and who is entitled to the insurance benefit?
Article 125(1) makes the insured responsible for proving that an item lost or damaged belongs to the insured collection. A total of household spending is not enough: the specific item needs to be connected with the insured property. The law does not make a single photograph automatic confirmation of inclusion or value.
Paragraph 3 adds that, for the extensions in the preceding paragraph, the insurance benefit belongs to the owner or the holder of equivalent property rights. The person named in the policy and the person owning the item can therefore occupy different positions. This guide does not decide matrimonial ownership or a compensation amount in an individual claim.
Prepare an item-by-item review without exposing your home
As a preparation method, select a few items and record their description, ownership and available evidence references separately. Flag questions about third-party property or items subject to specific conditions, without inventing a purchase date or ownership change to complete the list. Keep the information private.
To compare new building and contents protection, select Home under Request a quote at RMACHADO. If damage has already occurred, use Support and claims and the current policy’s process. Comparing a new proposal does not retrospectively include property or confirm payment for an earlier loss.
