Can an employer deduct work accident insurance from an employee’s salary?

Tiago Faria sees the word insurance on his payslip and worries that he is paying for the employer’s work accident policy. In this fictional story, Clara Mota first separates the insurer’s name, a deduction and a possible different benefit. This guide concerns the Portuguese employees’ work accident regime.

THE ESSENTIALS

Before you start

  • Costs of this regime must not be deducted from the employee’s remuneration.
  • A payslip must identify the insurer; identification alone is not a deduction.
  • Clarify an ambiguous item before concluding what was charged.

Who has the insurance obligation?

Article 79 of Portuguese Law 98/2009 requires the employer to transfer liability for statutory work accident compensation to an authorised insurer. Article 13 prohibits deducting any amount from remuneration to compensate for costs arising under that regime and makes agreements for that purpose void.

An agreement presented as voluntary should therefore not be used to transfer that cost to the employee. This does not explain every deduction on a payslip or insurance arranged by a self-employed worker. Identify the employment relationship and the purpose of the item.

The insurer’s name can appear without taking money away

Article 177(2) requires payslips to identify the insurer to which the risk is transferred on their issue date. A name or insurance reference on the document does not establish that pay was reduced to fund the premium.

Clara asks Tiago to locate the information within the payslip: insurer identification, gross amounts, deductions and net pay. If an amount appears, request its full description, period and purpose. Do not confuse the mandatory identification with a line that actually changes the payment.

Clarify the item using the complete document

Tiago keeps the payslip and asks payroll whether any deduction concerns work accident costs. If the explanation refers to a different benefit, he asks for that benefit to be identified and its basis explained. He does not assume that health, group life and work accident insurance follow the same rule.

If the answer does not resolve the question or confirms a problematic charge, obtain competent employment-law support with the documents. This article does not declare that a particular employer broke the law, calculate a refund or recommend changing salary processing unilaterally.

Separate the employment issue from a future quotation

Keep the reply together with the period and item assessed. Avoid posting payslips, identification numbers or colleagues’ details in comments to obtain an informal interpretation. You do not need to expose your salary on social media to prepare this question.

Employers comparing protection for a team can select Work accidents under Request a quote on the RMACHADO site. That request concerns insurance: it does not settle a salary dispute, replace employment-law advice or activate cover.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Establish whether there is a deduction or just insurer identification.
  • Request the item’s description, purpose and period.
  • Keep the payslip and explanation in a private channel.
  • Seek competent employment-law support if uncertainty remains.
