An insolvent employer: will Portugal’s FAT pay work-accident benefits?

Tiago Faria stops receiving a work-accident benefit and hears that the responsible entity cannot pay. Clara Mota helps distinguish the debt, evidence of financial incapacity and possible FAT intervention. This fictional case does not predict a decision, amount or timetable in a real proceeding.

THE ESSENTIALS

Before you start

  • FAT intervention depends on legal conditions.
  • Payment difficulty alone does not establish entitlement to intervention.
  • The Fund’s existence does not dispense with compulsory insurance.

The Fund has a defined guarantee function

Article 1 of Decree-Law 142/99 provides for benefits the responsible entity cannot pay, including financial incapacity objectively established in insolvency or equivalent judicial proceedings, or business recovery. An informal explanation of insufficient money is not enough.

Identify the unpaid benefit, the responsible entity and documents establishing the obligation and proceedings. Do not treat a delay alone as confirmation of insolvency or a decision that the Fund will intervene.

Not every amount claimed falls within the guarantee

The same article excludes, for example, compensation for non-pecuniary damage and late-payment interest on overdue cash benefits owed by the responsible entity.

List each amount’s nature, the decision or document supporting it, payments made and sums outstanding. Keep different components separate for assessment. This sheet helps explain the problem; it does not calculate the Fund’s liability.

Insurance remains a separate duty

Article 79 of Law 98/2009 requires employers to transfer liability to authorised insurers. Article 82 provides for the FAT pension guarantee under special legislation. A subsidiary guarantee does not turn the Fund into the company’s policy.

Missing a benefit may affect Tiago’s essential monthly expenses. Clara helps preserve information and seek the appropriate assessment; she does not promise a payment date or present new insurance as a retrospective repair for the problem.

Prepare the matter through the appropriate channel

Keep accident references, any policy, decisions and communications. Obtain legal assistance or clarification from competent bodies about intervention conditions and required procedural steps. Preserve the deadlines in your case; this article does not suspend them.

RMACHADO may help organise insurance-contract and mediation information, without deciding Fund benefits or automatically representing judicial proceedings. For a company’s current protection, you can request an occupational accident quotation on the site. Medical information and personal documents do not belong in public comments.
