Foreign worker in Portugal: is occupational-accident protection the same?

Nuno Patrício is reviewing the café team’s information and asks whether nationality changes occupational-accident rights. In this fictional story, Clara Mota starts with the applicable law and employment relationship, without selecting lower protection because a person is foreign.

THE ESSENTIALS

Before you start

  • Article 5 treats a foreign worker carrying out activity in Portugal like a Portuguese worker for this law’s purposes.
  • Protection provided for relatives also applies to the foreign worker’s relatives.
  • Temporary work for a foreign company requires checking the statutory exception, not nationality alone.

The law expressly provides equal treatment

Article 5(1) of Law 98/2009 treats a foreign worker carrying out activity in Portugal like a Portuguese worker for this framework’s purposes. Article 3 addresses employees. Nationality alone is not a basis for removing the protection provided by the law.

This does not automatically recognise every incident as an occupational accident or make all relationships legally identical. Identify the employer, relationship and activity concerned. This guide does not determine residence status, work authorisation or the classification of an individual case.

The rule includes relatives too

Article 5(2) extends the protection established for an injured worker’s relatives to that foreign worker’s relatives. It must be read with Article 2 and the conditions of the applicable benefits. Being a relative does not by itself establish entitlement to any amount or a particular pension.

As an organisation method, separate information about the worker from that about anyone acting as relative or beneficiary in the claim. Ask which capacity and documents the benefit concerned requires. Do not expose identification documents or family relationships in social-media comments to seek a decision.

The temporary-work exception has conditions

Paragraph 3 addresses a foreign worker injured in Portugal while serving a foreign company or its agency, branch, representative or subsidiary. Possible exclusion from this framework requires temporary or intermittent activity and an agreement between states providing for the home state’s protection. Saying that the company is headquartered outside Portugal is insufficient.

Where these circumstances arise, identify the country, employer, period, location and documented basis of the assignment. Seek confirmation of applicable legislation and protection, with specialist assistance when needed. Do not choose a regime for convenience or treat a card or verbal promise as sufficient proof that this exception applies.

The employer’s obligation still needs to be implemented

Within the covered framework, Article 79 requires the employer to transfer compensation liability to entities authorised to provide this insurance. Equal treatment of a foreign worker does not replace correctly arranging and maintaining that transfer. Nuno must check the actual team and policy situation rather than using nationality as the answer.

To prepare the request, organise roles, locations, admission dates and current remuneration through the appropriate channel. Check how workers and earnings are reported under the contracted arrangement. An internal staff list or a quotation request still pending does not demonstrate that liability has been transferred.

Working in Portugal differs from being sent abroad

Article 6 addresses another situation: a Portuguese worker, or foreign worker residing in Portugal, injured abroad while serving a Portuguese company. It provides compensation and choice-of-framework rules where the respective conditions apply. Do not apply Article 5 as though the accident’s country and employer were irrelevant.

Clara helps Nuno complete four fields: where work happens, for whom, for how long and what protection is documented. For a future quotation, select Acidentes de Trabalho on the RMACHADO website. An existing accident requires its proper procedure; this organisation neither recognises an employment relationship, determines posting law nor confirms a benefit.
