Glasses broken in a work accident: who pays for repair?

Dr. Marta Sequeira is an employee at a clinic and wears prescription glasses. After a fall at work, she finds the frame damaged. In this fictional story, Clara Mota helps separate personal medical care from assessment of the glasses, without deciding whether the event qualifies as a work accident or who must pay.

THE ESSENTIALS

Before you start

  • Existing visual aids have a specific rule under the work-accident regime.
  • Repair, equivalent replacement and choosing another model are different questions.
  • An optical purchase alone does not establish payment through the process.

Start with the work-accident regime

Under Law 98/2009, Articles 41 and 43 address visual aids: the entity responsible for the accident bears necessary repair or replacement costs for existing devices it damages. Replacement is limited to the cost of an equivalent aid unless another is more suitable. Article 46 makes an exception for deterioration caused by gross negligence.

This guide considers the employee regime and assumes that a qualifying work accident is established. It does not make every item broken at a workplace an accepted expense. Describe prescription glasses, protective eyewear and accessories without a corrective function accurately.

Describe the device and damage

Marta separates three facts: the glasses she already used, what happened in the fall and the visible damage. Care for any injury comes first. Assessing the frame and lenses must not delay urgent treatment.

As practical preparation, keep relevant photographs, model identification and available supporting documents. Ask the optician to itemise the frame, lenses, possible repair and proposed replacement. Do not change the description to present a new model as identical to the previous one.

An estimate is not authorisation

Before ordering a replacement on the assumption that the process will pay, ask the responsible entity to clarify the procedure, information needed and solution being assessed. If an expense has already occurred, provide the true chronology; this guide neither suggests hiding it nor guarantees reimbursement.

Preferring a different frame and documenting a functional need are different justifications. Clara suggests asking: is the assessment about repairing the existing glasses, replacing them with equivalents or adopting another solution considered suitable? Keep the reasons given and the outstanding questions.

Use the existing process for the occurrence

Send only necessary information through the confidential channel specified for the process. Prescriptions and clinical information do not belong in public comments or social-media messages. If you disagree with the assessment or proposed solution, ask for written reasons and seek appropriate legal help where needed.

For an event that has already happened, use Support and claims. To review future employee protection or prepare a new policy, select Work accidents in RMACHADO’s quotation request. That enquiry concerns future needs: it neither decides the earlier event nor activates cover.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Identify the glasses’ function and the device already in use.
  • Record the accident and damage without assuming the process outcome.
  • Obtain an itemised estimate and clarify the procedure before ordering.
  • Keep the response and protect prescriptions and clinical information.
