THE ESSENTIALS
Before you start
- Notifying a claim and enforcing a right within its limitation period are separate matters.
- The current regime provides for five years from knowledge of the right, without displacing ordinary limitation from the event.
- The relevant date and effect of communications require assessment of the actual case.
Notification communicates the event
Article 100 of Portugal’s Insurance Contract Law requires notification within the contractual period or, if none is fixed, within eight days of knowledge of the insured event. Article 101 regulates possible consequences of non-compliance and their conditions. Late notification does not automatically mean loss of the entire benefit.
Henrique collects the policy, notification and replies, preserving their dates. This helps identify what has already been communicated. Clara does not treat the mere existence of a claim reference as proof that the right was accepted or that every deadline was preserved.
Limitation has a different rule
Article 121(2) provides for five years from the date the right-holder knew of the right, without prejudice to ordinary limitation running from the event that gave rise to it. Civil Code Article 309 sets ordinary limitation at twenty years. These references do not justify waiting twenty years or always counting five years from a death.
For life insurance covering disability or associated with a mortgage, identify the benefit, who holds the right and which facts establish knowledge of it. If documents are old or there is doubt about which regime applies over time, take the chronology to a professional qualified to assess limitation periods.

An email subject does not determine its effect on time limits
The Civil Code provides for interruption by certain judicial acts in Article 323 and by acknowledgement of the right by the person against whom it can be exercised in Article 325. Tacit acknowledgement requires facts expressing it unequivocally. An acknowledgement of receipt or request for documents should not, from its heading alone, be treated as acceptance of the benefit.
Clara suggests keeping complete communications and evidence without concluding that every email interrupts limitation or that no communication can do so. If a deadline may be close, seek legal help without waiting for an informal reply. A complaint and court proceedings are not automatically equivalent.
Organise the file without postponing the time-limit assessment
Prepare a chronology of the event, knowledge of the possible right, notification, replies and acts already taken. Include policy versions and identify dates you cannot yet establish. Do not expose medical information, identity documents or beneficiary details in public comments or messages.
For clarification under an existing policy, use Policy support and the private case process. To compare future mortgage-linked life protection, select Life under Request a quote. A new quote does not preserve an old right, decide beneficiaries or determine the limitation date in an individual case.
