A machine damaged a wall: does casco also deal with third-party losses?

One manoeuvre may damage both the machine and somebody else’s property. The equipment repair estimate does not answer the second part. Before comparing limits, identify whose loss each item concerns and whether liability cover has actually been selected.

THE ESSENTIALS

Before you start

  • Insured equipment damage and harm caused to third parties concern different interests.
  • Liability may be an optional section of the product.
  • A third-party claim is not, by itself, an indemnity decision.

Read the proposal as two separate lines

On the MAPFRE machinery casco page consulted, equipment damage concerns insured assets identified and valued in the policy schedule. Liability is shown as optional. This illustrates why the actual selected sections matter; it does not establish that every machinery policy has the same structure.

Check the use being described

The MAPFRE IPID available when checked, bearing printed reference 01012021, summarises liability where selected and mentions land transport in a suitable vehicle, including loading and unloading. It remains a summary: confirm the actual proposal, complete terms and applicable contract version. Do not treat this document as a current quotation or proof that your machine is already covered.

Separate losses without deciding liability

Fictional example: a manoeuvre damages a machine and another company’s wall. Create two lines in your incident record. One identifies the machine, its own damage and repair estimate. The other identifies the third-party property, the known circumstances and any claim received. Do not combine both estimates as though the same section necessarily applies.

If someone is injured, emergency assistance and safety come first. Record the existence of an injury without publishing medical information. Do not assume someone is a third party under every section simply because they do not own the machine: employment relationships and other circumstances need clarification through the appropriate process.

Ask about the actual machine and task

When comparing proposals, bring the machine identification and a concrete account of its tasks: movement, excavation, loading, attachments or work at a client’s premises. Note who operates it and who owns nearby property, without disclosing unnecessary personal details in the initial request.

Ask where liability is selected, the limit and excess, and restrictions relevant to the activity described. Clarify travel and circulation separately. This article determines no specific machine’s legal insurance obligations and does not replace risk assessment.

If damage has already occurred

Use support for the existing policy, retain the claim received and follow the procedure for notifying known facts. Separate direct observations, information from others and matters requiring technical assessment. Having insurance does not authorise you to tell the third party that their estimate has been accepted.

For future protection, select Plant and Machinery in the RMACHADO request and explain that you want to clarify equipment damage and liability. A new quote provides no retrospective cover, determines no liability and confirms no payment.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Separate equipment damage from third-party loss.
  • Match the machine, task and selected sections.
  • Request the liability limit, excess and scope.
  • Clarify employment relationships where relevant.
  • Notify the incident without promising payment.
