Life insurance capital exceeds the mortgage debt: who receives the remainder after a death?

The loan balance is lower than the capital shown on a life policy. Following a death, that difference should not be treated as money automatically available to any relative. First establish the benefit due for the insured event and the beneficiary provisions.

THE ESSENTIALS

Before you start

  • Insured capital and mortgage debt can serve different purposes.
  • Subsidiary beneficiary provisions matter when capital exceeds the debt.
  • An illustrative calculation neither confirms payment nor selects a beneficiary.

The specific rule for a different insured capital

Article 6 of Portuguese Decree-Law 222/2009 requires a policy with capital different from the mortgage debt to provide a method for determining subsidiary beneficiaries where insured capital exceeds the borrowed amount. ASF guidance likewise highlights naming the beneficiary of the remainder.

This separates two questions: what is payable to the creditor, and who is entitled to any excess? The answer needs the applicable policy wording; a family relationship alone does not resolve it.

A calculation that identifies the question

Fictional example, assuming a covered event, a payable benefit of EUR120,000 and relevant debt of EUR100,000: the arithmetic difference is EUR20,000. Those figures identify the part for which beneficiary entitlement must be established.

The example does not confirm amounts in an actual claim. Where several people, protection percentages or additional arrangements are involved, first obtain the applicable benefit calculation. A headline capital figure is not automatically the amount due.

Read the entire beneficiary provision

Obtain the relevant policy, certificate and endorsements. Locate the lender, the wording defining its entitlement and the method for identifying any remaining beneficiaries. Follow references to other conditions rather than reading one sentence in isolation.

Do not assume the balance necessarily belongs to a spouse, heirs or the policyholder. An old document or a family's intentions cannot replace the current designation. Succession questions or disputed interpretations may require legal advice.

Prepare a question that can be answered

Ask the insurer to identify the beneficiaries considered, the calculation basis and documents essential to the process. Keep this request separate from any personal decision to change beneficiaries under another policy.

Before a claim occurs, privately organise the current capital, debt and designations. RMACHADO can help prepare questions and a quotation request; it does not determine beneficiaries or promise a claim payment.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Identify the insured event and applicable benefit.
  • Compare capital and debt for the relevant situation.
  • Locate the creditor and remainder provisions.
  • Check current certificates and endorsements.
  • Request the calculation basis and a secure document channel.
