Workplace accident: does the one-year deadline always start on the accident date?

Tiago Faria, an employee in this fictional story, has received documents following a workplace accident. He has heard that he has “one year” and plans to count from the fall. Clara Mota helps distinguish the legal reference point from a calendar date selected without reading the case documents.

THE ESSENTIALS

Before you start

  • Article 179 concerns the right of action, not waiting to notify insurance.
  • The law refers to clinical discharge formally communicated to the injured worker; if death results, to that date.
  • Assessing a specific deadline requires documents and competent assistance, without waiting until the last day.

One year for what, and from which point?

Under the general framework, Article 179(1) of Law 98/2009 provides for the right of action to lapse one year after clinical discharge is formally communicated to the injured worker or, if death results, after death. Lapse means that expiry of the period may prevent exercise of that right.

Tiago first identifies what he wants to resolve: accident notification, disagreement about discharge, recognition of rights or an already established benefit. He does not use “claiming on insurance” to merge those issues. This guide explains the statutory reference point; it does not decide whether Tiago’s right has lapsed or calculate his last date to act.

The appointment date does not tell the whole story

Clara helps Tiago organise three separate records: when the accident happened, the discharge recorded in the report and how it was communicated to him. A personal note about returning to work should not replace reading the documents. A missing copy or discrepancy between records calls for prompt clarification.

Article 35 governs the discharge report and Article 175 requires official forms. Keep the complete document and evidence of the communication received. The validity, communication and effects of a disputed discharge cannot be resolved simply by finding a date in a message. Do not assume you can wait indefinitely because a document is missing from your folder.

Insurance notification and court action follow different channels

Reporting the occurrence to the employer or insurer is necessary for following up the accident, but Tiago does not assume that an email, commercial complaint or exchange of messages by itself preserves the right of action. Article 92 allows notification of the accident to the competent court by the injured worker, among other specified people.

The Public Prosecution Service’s Labour Area FAQs explain its advice service and representation in workplace-accident matters. If unsure about a deadline or rights, promptly seek the competent service or legal assistance. Take the case reference and establish what step is required, instead of waiting solely for the insurer’s next reply.

A useful timeline without invented certainty

On one page, Tiago separates fact, document and question: “I received this communication”, “this discharge is recorded here”, “I do not understand this effect”. He keeps originals, available envelopes or digital delivery evidence and replies. If he does not know a date, he marks the uncertainty instead of estimating it to make the timeline look complete.

For someone relying on wages, concern about cost can delay seeking clarification. Official information about the advice service is a starting point for finding available routes. The case’s framework, time calculation and any steps affecting the deadline need their own assessment. Do not use this guide to decide that it is already too late or that plenty of time remains.

What to do now

Gather the accident reference, clinical documents and communications, sharing them only through the indicated private channel. Seek clarification about exercising rights without waiting for the accident’s anniversary. If court proceedings already exist, identify them when requesting assistance so the same situation is not treated as a new case.

Clara keeps two tasks separate: support for the existing case and preparation of future protection. Policy support helps organise the insurance question; a new occupational-accident quotation does not preserve a court deadline or change a past accident. This guide does not determine incapacity, cover or an individual payment.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Identify the issue and case to which the deadline relates.
  • Keep the discharge report and communication evidence; do not guess missing dates.
  • Seek competent assistance promptly and establish the necessary step.
  • Separate insurance follow-up, court action and future protection.
