Driven hunts in Portugal: does the organiser need its own insurance?

Collecting hunters' individual insurance certificates does not complete insurance preparation for a montaria, batida or largada. Identify the entity responsible for staging it and the contract addressing that entity's liability.

THE ESSENTIALS

Before you start

  • Individual hunters' cover does not settle the organiser's duty.
  • Order 180/2018 sets minimum conditions for this liability insurance.
  • Record the responsible entity, activity, place and period.

A duty concerning the responsible entity

Article 76 of Portugal's hunting regime provides for liability insurance for entities responsible for montarias, batidas and largadas. Order 180/2018 specifies cover for the duty to compensate third parties for harm arising from those entities' acts or omissions.

The order sets a minimum of EUR 100,000 per claim and a national territorial scope. This figure concerns the responsible entity's insurance discussed here; do not use it to infer amounts in other policies.

Prepare two lists

Our suggested first list concerns the entity and records its name, organised activity, place, date and insurance document to check. The second concerns participant checks and should not be treated as evidence for the first.

Fictional example: a group supplies valid individual certificates and the event changes organising entity. Clarify the contract concerning the entity actually responsible, rather than filing only participants' documents.

Separate liability and personal injury questions

«Which contract addresses the entity's liability?» differs from «What protection exists if a participant is injured?». Request separate consideration of relevant benefits for the latter; do not assume the first contract is personal accident cover.

Describe the actual event for the entity's insurance file. If support services or teams are involved, explain their roles and who engages them. This organisational suggestion does not determine liability for an accident.

Confirm before the event

Have the proposal or contract checked against the entity and activity described, and retain confirmation before the event. Clarify authorisation or activity-classification questions with the competent authority.

You can request a quote from RMACHADO with responsible-entity and event details. Insurance mediation does not replace legal requirements for staging the event or promise acceptance of every risk.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Identify the entity responsible for staging the event.
  • Describe activity, place and period.
  • Separate organiser and participant documents.
  • Check liability insurance and any further protection needed.
