Does a pre-existing condition exclude compensation for a work accident?

Tiago Faria had a health condition before an accident at work. In this fictional story, he fears that this information ends the discussion. Clara Mota helps him distinguish the previous condition, its connection with the accident and any disability already formally assessed.

THE ESSENTIALS

Before you start

  • A previous predisposition does not by itself exclude compensation; the law makes an exception for concealment.
  • Aggravation and previous permanent disability have their own rules.
  • Clinical causation and individual rights require assessment of the case.

A previous condition is not an automatic answer

Article 11(1) of Law 98/2009 provides that a pathological predisposition does not exclude full compensation unless concealed. Here, predisposition concerns an earlier condition relevant to the injury; it is not automatically the same as permanent disability previously assessed.

Concealment is an express qualification. It does not establish that every old diagnosis was hidden. Tiago gathers the case information and asks which facts and reason the assessment relies on. Clara does not determine concealment or suggest omitting medical history.

Aggravation is more than separating old and new

Paragraph 2 concerns an accident-related injury or illness aggravated by an earlier condition, and the reverse situation where the accident aggravates that condition. Disability is assessed as if all of it resulted from the accident, subject to the qualification where a pension is already being received or a redemption lump sum has been received for the earlier condition under this law.

Fictional example: a report records an earlier change and a further change after the accident. That sequence does not let the reader allocate percentages to each cause. The useful question is how the assessment considered the interaction between the earlier condition and the accident consequences.

Existing permanent disability changes the question

For permanent disability predating the accident, paragraph 3 provides compensation corresponding to the difference between the earlier disability and that assessed as if everything were attributable to the accident. This differs from merely having a diagnosis; it is not a pension calculator based on subtracting two amounts selected by the reader.

Clara asks Tiago to identify any earlier decision and the benefit concerned, instead of using disability to mean a symptom, temporary absence and a permanent assessment interchangeably. Where there is disagreement, medical and legal assessment needs the documents and the rules applicable to the case.

The accident and injury still require assessment

Articles 8 and 10 address what constitutes a work accident and proof of the origin of an injury. Protection concerning predisposition does not remove those requirements. This guide concerns the employee regime in Article 3; it does not classify every illness as a work accident.

Tiago prepares a timeline of the event, reported symptoms and assessments received. He separates observations from matters requiring clinical confirmation. Reports follow the appropriate confidential channel, without medical information in comments, social media or general initial-contact forms.

What to do before deciding that a right has been lost

Ask for an explanation distinguishing the previous condition, its connection with the accident and the basis of any decision. Keep the communication and obtain appropriate clinical and legal support where necessary. Do not delay care while arranging paperwork or treat this article as a ruling on cover, disability or compensation.

For an existing case, use policy support and provide the reference through the indicated channel. A new work accident insurance quotation concerns future protection; it neither recognises nor refuses rights arising from an earlier accident. Clara makes that distinction clear to Tiago.
