Road and work accident: can I keep my claim against the third party?

Tiago Faria is an employee and has a road accident on a journey connected with his job. In this fictional story, he asks Clara Mota whether opening a work-accident claim requires him to abandon his claim against the third party. The answer requires separating the right to claim, the accident's classification and payments already received.

THE ESSENTIALS

Before you start

  • Work-accident compensation does not automatically remove the right to sue a third party.
  • Two proceedings do not allow payments to be added without identifying what they compensate.
  • The employer or insurer may have rights of their own in proceedings against the liable party.

The work-accident claim does not by itself remove the other route

Article 17(1) of Law 98/2009 provides that, when another worker or a third party causes an accident, the right to compensation owed by the employer does not prejudice an action against them under the general rules. Article 26 of Decree-Law 291/2007 coordinates the road-accident regime with special work-accident legislation.

This does not automatically classify Tiago's journey as a work accident or decide road liability. This guide concerns the regime for employees. Tiago identifies both proceedings and the stated basis of each, rather than treating opening one as abandoning the other.

Payments must be linked to the losses they address

Article 17(2) and (3) regulate how compensation obtained from another worker or third party affects the employer's obligation. Under paragraph 2, compensation exceeding that owed by the employer may release the employer and give rise to reimbursement of amounts paid; paragraph 3 limits the exclusion of liability to the amount of compensation lower than the work-accident benefits.

Clara asks Tiago to identify the loss and period to which each amount relates. She neither subtracts the overall totals of both proceedings nor assumes that any payment extinguishes every right. Applying these rules to specific components requires its own assessment; this guide calculates neither a repayment nor compensation.

The employer and insurer have rights to consider

Paragraph 4 allows an employer or insurer that paid to become subrogated against those responsible if the injured worker has not claimed compensation from them in court within one year of the accident. Paragraph 5 provides for their intervention as a principal party in proceedings brought by the worker. That one-year reference concerns the condition for subrogation; this guide does not establish it as Tiago's general time limit to act.

When preparing, Tiago keeps records of who paid, for which component and in which proceedings. If he receives a settlement offer or discharge, he takes the full text to those assisting with the case to clarify its effects. Clara does not recommend waiting until the year ends, bringing an action or accepting an offer.

One consistent account for two distinct routes

Notify the employer and follow the applicable reporting procedures, identifying the other proceedings to those involved. As an organisational method, use the same factual account of the accident and a record of expenses, benefits and payments, with separate references. Do not present incompatible accounts or conceal an amount already received.

For an existing accident, use Support and claims and the indicated private document channel. Questions about time limits, settlements or effects between proceedings require appropriate legal assistance. To compare future employee protection, select Work accidents in RMACHADO's 'Request a quote'; that request does not settle the earlier accident.
