THE ESSENTIALS
Before you start
- Article 71(7) provides a specific reference for training situations.
- The amount received should not be confused with the compensation base.
- Identify the corresponding activity and request the criterion used.
Training has a specific rule
Article 71(7) of Portugal's Law 98/2009 provides that, where the injured person is a practitioner, apprentice, trainee or in another situation regarded as vocational training, compensation is calculated using the average gross annual remuneration of a worker in the same or a similar business performing the activity corresponding to that training, apprenticeship or traineeship.
The reference is therefore not simply a copied allowance or the last amount paid. Nor is it the highest salary in the business. The corresponding activity and chosen reference must be substantiated. Article 3 frames vocational training within the Act; the actual arrangement needs identifying before applying this rule.
Identify the comparison supporting the reference
Nuno records the role being learned, expected tasks and document governing the training. He asks the accountant and intermediary which evidence is needed to clarify reference remuneration and its communication for insurance. He does not substitute a guess for missing information just to finish the request.
As a checking method, separate four fields: training arrangement, corresponding activity, annual reference remuneration and supporting document. If a similar business supplies the comparison, request an explanation of that reference. The record organises questions; it does not itself establish the amount due.
The base is not the amount ultimately paid
Article 71 contains remuneration-calculation rules, including the annual concept and a minimum arising from legislation or collective regulation. A remuneration base is not the final compensation result: the relevant benefit and other applicable legal elements still matter.
Clara asks Nuno not to promise a payment equal either to the allowance or to the reference remuneration. After an accident, the explanation should identify the benefit calculated, its base and how that base was obtained. A proposal field does not determine incapacity, classification of the accident or every party's obligations.
Present the training arrangement before relying on a generic answer
For future protection, select Acidentes de Trabalho in Request a quote and explicitly state the apprenticeship or traineeship, legal arrangement, tasks, locations and dates. Information about one programme, such as a +Talento traineeship, must not automatically be transferred to another arrangement.
For an accident that has already happened, use policy and claims support and the existing case. Keep employment documents in the designated private channel. For a small business, identifying the necessary information helps avoid price comparisons based on incomplete references; a quote request neither automatically includes a person, issues a policy nor confirms compensation.
