Work accident in Portugal: can I choose my treating doctor?

Tiago Faria is injured during a task and wants to book the doctor he already knows. In this fictional example, Clara Mota separates two questions: obtaining necessary immediate care and deciding who handles follow-up. This guide concerns Portugal’s regime for employed workers.

THE ESSENTIALS

Before you start

  • Immediate care should not wait for an insurance discussion.
  • The party responsible for compensation normally has the right to appoint the treating doctor.
  • The law identifies circumstances in which the worker may consult another doctor.

Necessary immediate care comes first

Article 26 of Law 98/2009 requires the employer to ensure immediate and essential medical and pharmaceutical assistance and suitable transport. This duty applies independently of a preliminary assessment of the legal conditions for compensation.

An emergency should not wait for a claim number or an argument about payment. Seek appropriate assistance and report the occurrence through the applicable procedure. This article does not assess symptoms or recommend treatment.

Who appoints the treating doctor?

Under article 28, the party responsible for compensation has the right to appoint the treating doctor. Preferring a particular professional does not, by itself, make every independently booked consultation reimbursable.

Ask the employer or insurance contact to identify the appointed follow-up, contact details and consultation instructions. Record who gave the instructions and when. Do not confuse the first facility providing urgent care with a confirmed choice for every subsequent appointment.

Exceptions identified in the law

The worker may consult any doctor when urgent help is needed and the employer or representative is absent; when the responsible party has not appointed a doctor, or until it does; or when it waives its right to choose. Until a doctor is appointed, the doctor treating the injured worker is legally regarded as the treating doctor.

The law also addresses discharge before recovery. In that situation, the worker must request examination by the court’s medical expert. A clinical disagreement needs the appropriate procedure; simply disregarding discharge or stopping follow-up independently does not resolve it.

A useful record for Tiago

Clara suggests a timeline: accident, initial care, contact with the employer and instructions about the doctor. Tiago keeps communications and clinical records for the confidential claim process. He does not post diagnoses in a colleagues’ group.

For someone depending on a monthly wage, paying consultation fees in advance can strain the budget. Before arranging non-urgent care outside the indicated follow-up, Tiago asks about its treatment under the process and the documents required. This prepares the enquiry; it guarantees neither reimbursement nor classification of the accident.

What to do

1. Obtain appropriate immediate care and report the occurrence without waiting for your own coverage conclusion.

2. Confirm the appointed treating doctor and retain the contact details and instructions.

3. If no appointment has been made or another legal exception may apply, record the relevant facts and seek guidance through the claim channel.

4. If discharge is disputed, promptly seek guidance about examination by the court’s medical expert. Share clinical documents only through the appropriate process.
