THE ESSENTIALS
Before you start
- An authorised bicycle space is not damage insurance or, by itself, proof that the carrier took custody of the bicycle.
- Stowage rules must be read alongside legal rights, without assuming automatic compensation or refusal.
- Check which means of transport the policy describes: a car and a train are not equivalent terms.
Taking a bicycle on board is not the same as handing over registered luggage
CP’s current page places responsibility for stowing, boarding and alighting with a bicycle on the customer. It also states that CP does not accept responsibility for damage or theft. These are conditions published by the operator and must be read alongside the law. A reservation or available hook alone does not establish that the bicycle was handed into the company’s custody.
Clara asks Inês to record the arrangement actually used: an assembled bicycle on a rack, or a folded bicycle stowed as hand luggage, depending on the service. She records who placed it, how it was secured and when it fell. She does not replace those facts with the broad statement “CP was carrying it” or assume that one service’s rules apply to every train.

The custody rule does not settle legal liability
Article 25 of Portuguese Decree-Law 58/2008, as republished by Decree-Law 173/2026, provides for operator liability for damage to property carried by passengers under the applicable regime and sets out exclusions. Article 7-B(2) prevents contractual restrictions of legal rights from being binding on passengers. The railway amendments have effect from 1 October 2026.
CP’s published statement should therefore not, on its own, be used to avoid assessing an alleged rack defect or other conduct by the operator. Nor does it make CP liable for every fall. The cause, compliance with stowage duties and the regime applicable to the incident must be established. Damage to the wheel is separate from an injury to Inês or compensation for a delayed train.

In a policy, “during carriage” may refer only to a car
One example helps explain the wording: in Generali Tranquilidade Bicicleta e Trotinete terms 507.041, May 2025, benefit 6(b) of Multi Assistência VIP refers to a road accident while the bicycle is being carried in a motor car in which the policyholder is travelling. The special condition defines a road accident by reference to road traffic. This paragraph does not confirm damage occurring on a train.
This reads one provision of that product; it does not conclude that every policy excludes rail carriage or decide Inês’s policy claim. For assessment, she presents the exact scenario and asks for any clause applicable to her bicycle as property carried by rail. Liability cover for damage caused to other people or their property answers a separate question.
Record the incident and follow both requests
Inês reports what happened to the operator, identifies the train, date, carriage and rack, and keeps her ticket, pictures of the bicycle’s placement and damage, and the repair estimate. She states what she saw and what remains unclear without declaring an unverified defect. AMT identifies the operator’s channels and the complaints book as ways to complain; keep the request and proof of submission.
If she has insurance, Inês also checks her policy’s procedure and deadlines without assuming that a complaint to the operator replaces it or that she must wait for the operator’s decision before contacting her insurer. Clara keeps the two questions clear: what liability is claimed from the carrier, and which event does the insurance policy cover? Before her next journey, Inês uses this scenario to clarify the protection she wants.

KEEP THESE QUESTIONS
Your checklist for the next conversation
- Record how the bicycle was stowed and who placed it, without assuming why it fell.
- Give the operator the incident details, damage and journey documents, keeping proof of submission.
- Ask the insurer for the clause addressing damage to a bicycle carried by rail and identify your policy’s edition.
- Follow each entity’s procedures and deadlines; distinguish the bicycle claim from injury or delay.
