An occupant is injured on the boat: do liability and Personal Accident cover answer the same question?

The boat policy mentions liability and a hull sum insured. Those two entries do not explain every protection for the people on board. To understand what happens when an occupant is injured, also identify Personal Accident benefits and how occupants are included.

THE ESSENTIALS

Before you start

  • Hull, liability and Personal Accident cover serve distinct purposes.
  • Check the per-person limit and people included.
  • Read boarding and disembarking scope expressly.

A public example separates the covers

Mútua dos Pescadores lists liability and optional occupant Personal Accident benefits for death, permanent disability, treatment and repatriation expenses. Its description refers to people aboard and boarding and disembarking operations. This is the advertised scope of that product, subject to the applicable conditions.

Start with the question you want answered

'What liability may arise for an injury caused to someone else?' and 'What accident benefit has been arranged for an occupant?' are different questions. Ask for the relevant cover and conditions rather than rely on the phrase 'the boat is insured'.

Fictional example: an owner invites friends aboard and reviews protection before the next outing. They prepare the expected occupancy and ask whether occupant Personal Accident cover exists, who is included and what benefits apply. They do not treat a hull-damage answer as confirmation about people.

Read per-person and per-event limits

Locate death, disability and treatment limits, the applicable disability assessment table and any combined caps. Ask whether the highlighted amount applies to each occupant or whether the same event has an overall ceiling. These are reading questions, not a description of universal benefits.

Also request the occupant definition, conditions concerning people operating or working on the vessel and the scope of access operations. If the contract uses an occupancy limit or identification method, check it against actual use; do not assume that dividing the hull value by the number of people answers the question.

Review before changing use

Describe private outings, paid activities and races accurately. Keep the response and the proposal version assessed. If an injury has already occurred, obtain appropriate care and emergency assistance and follow the policy's claims process; an editorial review does not determine liability.

For a RMACHADO simulation, select Embarcação and explain the use and occupant protection you want clarified. There is no need to post names, medical information or passenger documents on social media. A proposal requires assessment and acceptance.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Separate boat damage, liability and Personal Accident cover.
  • Check the definition and number of occupants.
  • Read per-person limits and combined caps.
  • Verify boarding, disembarking and declared use.
