THE ESSENTIALS
Before you start
- Record the origin, destination, route and timings.
- Describe stops and reasons without deciding cover.
- Classification requires facts and applicable legal conditions.
The route is part of the legal assessment
Article 9 of Portugal's Law 98/2009 includes certain accidents on normally used routes within the time usually taken, subject to the law's terms. It also addresses interruptions or deviations for legitimate needs, force majeure or fortuitous events.
A deviation alone therefore does not establish or rule out a work accident. Assessment must consider the circumstances and applicable requirements.

Build a short chronology
Use four stages: departure, any stop, accident and assistance. State the actual origin and destination, distinguishing recorded times from estimates. Note any different work schedule that day.
Fictional example: a worker takes an alternative route because a road is closed. The account identifies the closure, route and known timings. This shows how to organise information, rather than determining that accident's legal classification.
Describe interruptions accurately
Record any stop or deviation, its location, approximate duration and reason. Do not reshape the account to fit an imagined ideal route. Separate personal observations from information received from others.
Keep relevant existing evidence, such as messages about working hours or the road closure. Avoid adding third-party location data or health records unnecessary for the recipient.
Follow the applicable reporting procedure
Tell the employer and follow the insurance reporting and assistance process. Do not wait for your own view on cover before reporting the event. Necessary emergency assistance takes priority.
RMACHADO can help organise the enquiry and documents. This guide or a quotation does not decide classification; the facts and applicable regime require assessment.
