Practical guide · Behaviour and keeper obligations

Your dog is not a listed breed: can an incident change insurance obligations?

A breed's absence from the potentially dangerous-dog list does not settle the keeper's obligations. Portuguese rules distinguish that category from dangerous-animal status, which also considers behaviour and specific incidents.

THE ESSENTIALS

Before you start

  • Dangerous and potentially dangerous animals are different categories.
  • Behaviour-based classification can matter outside the breed list.
  • Reporting an incident and reviewing insurance are separate tasks.

Why breed does not answer everything

DGAV's dangerous-animal definition includes, among other situations, biting or attacking a person, seriously injuring or killing another animal outside the keeper's property, and aggression declared or recognised through the relevant authority.

It separately describes potentially dangerous animals through characteristics and the breeds or crosses specified in the rules. Asking only 'is the breed listed?' therefore does not replace considering an incident. The actual classification should be clarified with the competent bodies.

Mandatory insurance needs the correct framework

Article 10 of Portuguese Decree-Law 315/2009 requires liability insurance for keepers of dangerous or potentially dangerous animals. A product described simply as pet protection does not establish compliance with that framework by its name.

Obtain current documents and identify the animal, keeper, liability benefit and declared activity. Request confirmation of suitability for the applicable requirements, including capital and conditions. This guide does not determine that any particular policy is sufficient or invalid.

Do not conceal the incident during a review

Record facts, date, location, people involved and communications received, separating direct observations from reports by others. Follow the policy's claims process and obtain competent-authority guidance about obligations concerning the animal.

Do not assume that buying or changing insurance after the event covers that episode. Equally, an earlier policy does not remove the need to report relevant facts through the proper channels. An insurance response and an administrative decision serve different functions.

Review with documents and privacy

Retain new records or official directions and ask which insurance documents need updating. Distinguish a communication sent from confirmation of an amendment actually accepted.

RMACHADO can help organise animal-liability questions. Victim images, documents, names and incident details do not need to be published on social media. Responsibility and cover must be assessed through the appropriate process by the relevant parties.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Distinguish breed-based and behaviour-based status.
  • Record the incident and relevant communications.
  • Clarify obligations with the competent authority.
  • Check the animal, keeper and policy framework.
  • Report and review without assuming retrospective cover.
