THE ESSENTIALS
Before you start
- Exceeding the animal’s monetary value does not, by itself, rule out the treatment costs provided for in article 493-A.
- The rule requires liability and treatment costs to be assessed; it does not approve every amount submitted.
- The measure of civil compensation and the scope of insurance need separate examination.
The animal’s monetary value is not an automatic ceiling
Article 493-A(2) of the Portuguese Civil Code provides for compensation for treatment expenses even when they exceed the monetary value attributable to the animal. Paragraph 1 refers to the liable party’s obligation towards the owner or those who rescued the animal and incurred expenses for its treatment.
Rui therefore cannot answer this question simply by comparing an invoice with a purchase price. This rule specifically concerns injury to an animal. It also does not establish that every claimed expense is due, that Rui is liable or that an insurer has accepted the claim.
Identify the treatment, expense and who incurred it
The request should make clear which animal and injury each expense concerns, what treatment was provided and who incurred the cost. An estimate for a future procedure and an expense already incurred are different records. Keep their descriptions and dates without presenting one as the other.
In the example, Rui organises the invoices received and the information linking the procedures to the incident. Clara neither assesses clinical necessity nor instructs anyone to choose cheaper treatment because of the animal’s value. That assessment belongs within veterinary care and, where compensation is disputed, the competent process.
The civil rule does not make insurance unlimited
Articles 137 and 138 of the Portuguese insurance contract framework link liability insurance to an obligation to compensate third parties, on the agreed terms and within the applicable insured limit. Article 493-A does not remove that examination. Establishing that the animal’s value is not an automatic ceiling for treatment expenses differs from establishing the amount covered by a policy.
In the relevant policy, identify the insured people and animal, the liability covered, the limits and applicable conditions. Cover for the dog’s own care serves a different need: this question concerns compensation claimed for injury to another animal. The guide does not identify a particular policy as obliged to pay.

Bring the right question to the claim process
If a response invokes the animal’s monetary value, ask whether it is assessing treatment expenses under article 493-A or another part of the request. Also ask for liability, recognised expenses and any contractual limit to be distinguished. Keep the complete response and obtain suitable legal support if rights are disputed.
For an incident that has already occurred, use RMACHADO’s Support and claims route and the policy’s private channel. To review future protection, select Animal Liability in Request a quote. Necessary care requires timely veterinary attention; questions about documents or insurance are not clinical guidance. Clara helps Rui formulate questions without deciding the claim.
