Practical guide · Employment and self-employment

You have a job and invoice independent work: which activity matters for work-accident insurance?

You work for an employer during the week and provide independent services at other times. Finding a policy bearing your name is only the beginning. Identify the activities and their respective contexts when arranging insurance and when reporting an accident.

THE ESSENTIALS

Before you start

  • Employment alone does not remove the need to assess self-employed insurance.
  • Describe the role being performed when the occurrence happened.
  • A legal presumption where the regime is unclear is not a free choice of regime.

The distinction explained by ASF

ASF identifies compulsory insurance for employees and independent workers, with a specific exemption for production solely for personal or household use. Where both regimes apply and doubt remains, employment is presumed until disproved; established independent work can give rise to recourse. For several activities, ASF points to the contract covering the activity performed at the time.

Prepare two descriptions rather than one general occupation

Use one column for employment and another for independent services, including tasks, locations and usual travel. Do not reuse the employed job title where independent services involve different operations. Mark classification questions for specific clarification.

Fictional example: someone works in administration and undertakes independent repairs on Saturdays. Rather than declaring office work alone, they describe repairs and travel separately. The example neither classifies the legal relationship nor confirms acceptance of an activity.

Reconstruct the actual task after an occurrence

Record the date, time, place, task and relationship under which the work was performed. Provide relevant document references through the case channel without publishing customer information or employment documents. Separating known facts from assumptions is more useful than immediately labelling the accident.

If the applicable regime is unclear, identify the uncertainty and available evidence. Do not change times, journey purpose or tasks to fit a policy. The presumption is not permission to omit independent work.

Check each enquiry and confirmation

When comparing proposals, establish which activities were assessed, identified persons and the dates and terms actually accepted. A self-employment quote is not an amendment to an employer's policy. Keep the two relationships' documents distinguishable.

RMACHADO can help prepare a work-accident enquiry with both descriptions. After an accident, follow applicable procedures promptly. This guide determines neither the responsible party, legal employment status nor benefits in an individual case.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Separate employment from independent services.
  • Describe tasks, places and travel for each role.
  • Record the activity being performed at the time.
  • Clarify the regime without changing facts.
