THE ESSENTIALS
Before you start
- A planned move and necessary storage following an insured event are different situations.
- The owner's property cover and the warehouse's liability need separate questions.
- Assess the outward journey, storage period and return separately.
Why the goods are stored can change the question
CE42 of Fidelidade Multirriscos Empresas CG500, September 2026 ME009, links third-party custody to a need arising directly from an insured event, evidenced by an agreement. The clause contains limits and operates as complementary cover where the custodians have insurance for the same goods. This is one policy example, not a rule for every insurer.
Nuno and Clara therefore do not treat the label alone as permission for planned works. They ask whether an arrangement is available for that planned move and which document identifies the new location, goods and period. No answer has yet been obtained.
Prepare one sheet for the time away
As an organisational method, create four rows: departure, transport, storage and return. For storage, record the full address, intended dates, type of stock and maximum amount held at once, using a valuation basis to be confirmed. Identify who receives the goods and controls access.
Add a description of alarms, fire protection, exposure to water and any temperature requirements. If the period might increase, flag that possibility rather than presenting three weeks as certain. These details support assessment; they are not universal requirements or recommended sums insured.
The warehouse's insurance answers a different question
Ask the custodian to explain what its insurance protects: the goods it receives, its liability for damage, or another obligation. A statement that it has insurance does not identify the contract relevant to Nuno's stock.
Clara suggests two written questions: how are the owner's goods protected during storage, and on what terms might the custodian be liable? Keep the storage agreement, handover records and each party's response. Two answers about different matters do not promise full compensation.
Clarify the change before moving the stock
Article 91 of Portugal's Insurance Contract Law provides for reciprocal communication of risk changes relating to information relevant to the contract. Present a temporary move for assessment; notification alone does not establish acceptance of the new location.
Ask which covers, limits, excesses, exclusions and dates apply to each phase. For a future arrangement, request a Business Multi-Risk quotation from RMACHADO with this outline. A quotation request does not activate cover or decide the handling of a claim.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Explain whether the move is planned or follows an insured event.
- Identify the address, period, goods and maximum amount in storage.
- Separate property protection from the custodian's liability.
- Confirm transport, storage, return and the accepted document.
