Surrendering a capitalisation policy: is the entire payment subject to Portuguese income tax?

Receiving €10,800 from insurance into which you paid €10,000 does not, by itself, mean €10,800 of income. To understand a surrender's tax information, separate contributions, the positive difference identified and the net payment. Then check the rules applicable to the contract and the person.

THE ESSENTIALS

Before you start

  • Contributed capital and income are different amounts.
  • Partial exclusions depend on conditions beyond the number of years.
  • A tax illustration is not an instruction to surrender.

The legal starting point is the positive difference

Article 5(3) of Portugal's Personal Income Tax Code treats the positive difference between life-insurance surrender, advance or maturity payments and premiums paid or amounts invested as capital income.

It provides exclusions of one fifth of income after five and before eight years and three fifths after the first eight years, conditional on at least 35% of contributions being made during the first half of the contract term. These conditions do not establish your individual treatment.

A calculation that separates the amounts

Simplified fictional exercise: assume one €10,000 contribution and a relevant calculation amount of €10,800. The arithmetic difference is €800. This distinguishes contributed money from the increase; it does not calculate withholding, charges, final tax or exclusions.

For an actual transaction, request the insurer's calculation breakdown. List contributions considered, the gross transaction amount, itemised charges, taxable income identified, withholding indicated and estimated net payment separately. Ask about any missing line before comparing the result with the statement balance.

Check the contribution timeline

Prepare the start date and the record of contributions and previous transactions. Someone who added money on different dates should provide that history for assessment rather than apply a percentage found in an article to the entire withdrawal.

Identify the exact product too. A PPR, a contract subject to transitional rules or a non-resident situation needs its own verification. This guide explains the general reading of a capitalisation-policy surrender and does not provide a table of personal tax rates.

Request dated information before deciding

Ask for an illustration identifying the contract, the date considered and the tax assumptions. Ask what may change before execution. Clarify residence, reporting duties or special-regime questions with the Portuguese Tax Authority or an appropriately qualified professional.

RMACHADO can help assemble contractual information about financial life insurance. When requesting clarification, indicate whether you want information only or to assess an insurance need. Keeping or surrendering a policy requires separate consideration; this article recommends neither an investment nor a transaction.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Separate contributions, gross payment, gain and net amount.
  • Gather dates and transaction history.
  • Identify the product and applicable tax rules.
  • Request a dated calculation and assumptions before deciding.
