Life insurance: can a negligent disclosure error still be raised after two years?

Beatriz Rocha hears that, after two years, “life insurance can no longer be contested”. Clara Mota asks her to pause over that statement: the law restricts a particular ground for challenge, rather than promising payment of every claim. This fictional story explains the incontestability provision in Portuguese law.

THE ESSENTIALS

Before you start

  • The rule concerns negligent omissions or inaccuracies in the initial risk disclosure.
  • The statutory period runs from conclusion of the contract; a shorter period may be agreed.
  • Supplementary accident and disability covers have a specific exception.

What the two-year rule restricts

Article 188(1) of Portugal’s insurance contract regime prevents the insurer from relying on negligent omissions or inaccuracies in the initial risk disclosure once two years have passed since conclusion of the contract. The parties may agree a shorter period.

Negligent here concerns an unintentional failure. This rule does not turn deliberate concealment into an accidental mistake. Nor does it make a policy exclusion, an event outside the agreed cover or another decision ground disappear simply because time has passed.

Keep death and disability on separate lines

Article 188(2) makes a specific exception for accident and disability covers supplementary to life insurance: the preceding rule does not apply to them unless the contract provides otherwise. Including these benefits in one policy does not establish identical treatment for all of them.

Article 187 includes the incontestability provision among the policy information to be stated where relevant. Find it in the applicable wording and identify the benefit being discussed. The package’s commercial name cannot answer that question.

Use a timeline to clarify, rather than decide, the claim

In this fictional example, Beatriz has variable income and wants to understand a response without wasting time collecting irrelevant material. Clara suggests three fields: the contract’s conclusion date, the benefit claimed and the insurer’s written reason. A reference only to the latest renewal does not answer the question about when the contract was concluded.

Beatriz brings together the application, policy conditions and response. She marks what remains unclear and asks for the relevant facts and clauses to be identified. This organisation does not itself establish negligence, intention or entitlement to a benefit; it helps avoid arguing over an isolated phrase.

What to do

1. Identify when the contract was concluded and the specific benefit, keeping life cover separate from supplementary benefits.

2. Read the incontestability provision and check for a shorter period or wording addressing supplementary benefits.

3. Request the written grounds for a decision and use the designated channel for medical documentation; keep health information out of public posts.

4. Obtain appropriate assistance to assess a disagreement. To compare future life protection, use “Request a quote”; a new application does not settle an earlier claim.

Your checklist for the next conversation

  • Contract conclusion date identified.
  • Main and supplementary benefits separated.
  • Relevant provision and written decision located.
