A surety insurance claim has been paid: can the business still owe reimbursement?

A business provides a guarantee to its customer and pays the surety insurance premium. If the guarantee is called and the insurer pays, the business should not assume that every later obligation disappears. Before contracting, understand the provisions on recovering sums paid and the policyholder’s position.

THE ESSENTIALS

Before you start

  • Paying a premium does not establish that the policyholder is free of reimbursement obligations.
  • Article 165 addresses subrogation and the possibility of contractual recourse.
  • The beneficiary’s guarantee and the reimbursement relationship need separate review.

Locate the relevant provision

Article 165(2) of Portugal’s insurance contract regime provides that, alongside subrogation, a surety insurance contract may establish a right of recourse against the policyholder. Combining those claims cannot allow the insurer to demand more than the total amount spent. The consolidated source lets readers check the applicable wording.

Read the commitments given to the insurer too

Collect the proposal, insurance conditions and any additional documents required for the guarantee. Look for reimbursement, indemnity, recourse and counter-security provisions. Identify who assumes each commitment and what triggers it. Request an explanation of unclear wording before signing.

A provision describing payment to the beneficiary does not fully explain the relationship with the business. The conditions for calling the guarantee and what may be demanded from the policyholder after payment are different questions. Their assessment depends on the actual documents.

An example of financial organisation

Fictional example: a guarantee has a EUR50,000 limit and the premium appears on a separate invoice. The finance team retains both, but still needs to locate the provision for recovering amounts paid. The premium does not itself define the limit of every commitment the business may assume.

This example does not predict a future recovery amount. It helps organise the secured obligation, limit, premium, reimbursement documents and people responsible for review. Do not add guarantees or charges without identifying their nature, or mistake the guarantee limit for a loss already established.

If a reimbursement demand arrives

Organise the notice, contract, guarantee identification and supporting calculation. Distinguish acknowledging receipt from accepting the debt. Where there is a dispute, additional charges or deadlines with legal consequences, obtain appropriate legal assessment promptly.

RMACHADO can receive a surety quotation request with the underlying contract and obligation to be guaranteed. Ask about the potential reimbursement process before contracting. This guide does not accept a demand, resolve a dispute or guarantee that a policy will be issued.
