THE ESSENTIALS
Before you start
- The CCP provides for surety insurance and bank guarantees.
- Terms must preserve the contracting authority’s safeguards.
- Replacing existing security is a separate question.
Both forms appear in the law
Article 90(2) provides for cash deposits, state-issued or guaranteed securities, bank guarantees and surety insurance.
This answers which forms are provided for, rather than approving a proposal. Identify the form under consideration and the obligation involved. The word insurance alone does not establish that a document meets the procedure’s requirements.
Do not choose by the label alone
Paragraph 8 prevents bank-guarantee or surety-insurance terms from reducing the contracting authority’s safeguards.
As a comparison method, use two columns for the same obligation, beneficiary, amount and duration. Add charges, any counter-guarantees and unresolved questions from actual proposals. Do not fill a bank’s condition with an insurer’s answer or assume the two assessments are identical.
Henrique may be able to bear a charge but needs to understand the resources and commitments involved. Clara helps request complete terms; she does not claim that insurance always releases a credit line or is always cheaper.
Do not assume existing security has been replaced
Article 294 allows the public contracting party to authorise replacement on request, preserving payments already made and without reducing its safeguards.
An insurance quotation does not establish that authorisation. Identify the existing security and obtain competent help to coordinate any replacement and release. Do not treat a request as evidence that the former guarantee has ended.
Prepare a request for the actual procedure
Provide the procedure documents and current model, identifying initial provision or possible replacement. Record the proposal, wording review, any issue and submission to the competent entity as separate steps. Confirm procedural deadlines without waiting for a quotation.
You can request a surety-insurance quotation through RMACHADO, using the designated channel for documents. Assessment does not guarantee issue, acceptance or replacement. The intermediary does not carry the risk or decide procedural acts; legal discrepancies require suitable professional support.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Identify the form of security and actual obligation.
- Compare the same beneficiary, amount and duration.
- Distinguish initial provision from replacement.
- Confirm wording, deadlines and authorisations before relying on an outcome.
