Partial surrender: what leaves, what you receive and what remains in the policy?

Marta Sequeira wants to use part of an insurance-based saving and retain the rest. Clara Mota suggests comparing three lines: what leaves the contract, what reaches the bank account and what remains invested. This fictional story recommends no product, withdrawal or investment change.

THE ESSENTIALS

Before you start

  • Identify whether the request concerns an objective, an option or the whole contract.
  • Separate the withdrawal amount, costs, tax and net proceeds.
  • Check remaining capital and the terms that continue.

First identify the part to be withdrawn

The Fidelidade Savings — Opção Seguro KID dated 24 August 2026 allows full surrender of one objective to be only a partial surrender of the contract. It sets minimum withdrawal and residual amounts. This is one specific document, not a rule for all policies.

Write down the name and reference of the part being examined. The word full beside one objective should not be read as closing the entire policy. Marta asks for a simulation identifying the objective before authorising an operation.

Ask for a before, withdrawal and after breakdown

As a preparation method, place three columns side by side. First, the value and reference date before the operation. Second, the amount withdrawn, itemised charges, indicated tax withholding and estimated net proceeds. Third, the value and allocation remaining in each objective or option.

If you need a specified net amount, say so expressly. Ask what gross amount would be required and which assumptions were used. The statement balance and money to be credited should not be compared as though they were the same component.

The remaining amount needs its terms too

Article 194 of Portugal's Insurance Contract Law requires the contract to regulate any surrender and reduction rights. Where minimum values are guaranteed, it provides for a table referring to renewal dates. It does not create a universal right to withdraw any amount.

Ask the information to identify applicable minimums, the calculation date and what continues regarding guarantees, periods, allocation and future contributions. For fund-linked policies, also ask what may change between simulation and execution. These are reading questions; the answers depend on the contract.

Keep the simulation and make a separate decision

Marta checks that the simulation answers all three columns and that the documents distinguish objective from contract. Clara helps flag what still needs confirmation. Available cash alone does not settle whether the decision suits the saving's purpose and horizon.

RMACHADO can help organise contractual questions about insurance-based savings. Identify whether you want information only or an assessment of an insurance need. Check applicable tax effects with competent support; a request for clarification is not a surrender instruction.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Identify the objective, option and contract concerned.
  • Separate gross amount, charges, withholding and net proceeds.
  • Check the remaining capital and terms.
  • Retain dated information and distinguish simulation from execution.
