Course after a work accident: is enrolment enough to receive the allowance?

Nuno Patrício wants to understand how to support a café employee's return after an accident. In this fictional story, he asks Clara Mota whether enrolling on a course establishes that the allowance will be paid. The training's purpose, legal conditions and actual attendance are separate checks.

THE ESSENTIALS

Before you start

  • Enrolment alone does not establish entitlement to the allowance.
  • The law sets four cumulative conditions, including a favourable medical opinion.
  • Expenses, the organiser and actual attendance affect the support.

The support has a rehabilitation purpose

Article 69(1) of Portuguese Law 98/2009 allocates the allowance to expenses for actions restoring the injured person's vocational aptitudes and capacities, where the injuries' severity or other special circumstances justify it. This guide concerns the regime for employees following a work accident.

Nuno first identifies the proposed activity's purpose and connection with the case. Clara neither chooses the worker's occupation nor declares a course clinically suitable. A programme useful to the company and an action covered by this allowance do not necessarily answer the same question.

Four conditions must be checked together

Paragraph 2 requires remaining capacity suited to the occupation concerned and entitlement to compensation or a pension for incapacity resulting from the accident. The worker must also have requested attendance or accepted a proposal from IEFP or an institution it certifies, and obtain a favourable opinion from the medical expert responsible for assessing and determining incapacity.

IEFP is Portugal's Institute for Employment and Vocational Training. Nuno separates the programme, request or proposal and reference to the required opinion. Enrolment neither replaces that opinion nor establishes the incapacity situation. Medical information follows the private case channel; the employer does not determine remaining capacity.

Expenses and the organiser matter to the amount

Under paragraph 3, the amount corresponds to expenses incurred through attendance. If an entity other than IEFP organises the action or course, a monthly limit of 1.1 IAS applies. IAS is Portugal's social support index. This reference neither confirms every submitted item nor is converted here into a euro amount.

Keep the organiser's identity, itemised cost and relevant supporting records. Ask the response to identify the expenses considered and limit used. Do not combine training costs, wages and workplace alterations in one entry: each purpose requires its own basis.

The start is linked to actual attendance

Paragraph 4 provides for the allowance from actual attendance's start. Its consecutive or intermittent duration cannot exceed 36 months, except in duly substantiated exceptional situations. Reserving a place does not establish that the activity has begun, and the legal maximum does not promise payment throughout that period.

Nuno records the start, attendance periods and interruptions using actual documents. For an existing accident, use Support and claims and the competent case services. To prepare future team protection, select Work accidents in RMACHADO's 'Request a quote'; that request does not approve a course or an earlier allowance.

Your checklist for the next conversation

  • Identify the rehabilitation purpose and four cumulative requirements.
  • Separate the programme, request or proposal, enrolment and required opinion.
  • Check the organiser, expenses considered and applicable limit.
  • Record actual attendance and interruptions, distinguishing them from reservation or enrolment.
