Work accident: can I choose the surgeon for a high-risk operation?

Tiago Faria, an employee in this fictional story, receives information about an operation described as high risk following a work accident. Clara Mota helps him frame his question about the surgeon. She does not classify clinical risk or recommend undergoing, refusing or delaying the operation.

THE ESSENTIALS

Before you start

  • A specific choice applies in the situations covered by Article 32.
  • Attending doctor and surgeon are different roles.
  • Clinical disagreements have their own procedure.

A specific provision answers the question

Article 32 of Law 98/2009 gives an injured worker the right to choose the surgeon for high-risk operations or those that may endanger their life. This is a specific provision, distinct from the rule on appointing the attending doctor.

Tiago asks for an explanation of the proposed procedure and clinical circumstances. Feeling afraid or preferring a particular name does not, by itself, classify the operation under this provision. The relevant professionals should explain the necessary information.

Ask about this particular operation

Instead of only asking “can I use my own doctor?”, Tiago identifies the operation described to him and asks how to exercise the right of choice, where applicable. He requests the contacts and steps within his care arrangements.

Clara suggests retaining the answer with the accident reference. An appointment, a fee proposal and information about who manages follow-up are different documents. Do not treat a vague response as confirmation of every service or expense.

A clinical procedure exists for disagreements

Article 34 provides for a conference of doctors. Unresolved disagreements distinguish hospital admission, involving clinical management, from no admission, involving the labour court’s medical expert on the Public Prosecutor’s direction. The specific terms must be checked in the case.

Tiago organises the issue in dispute and asks which route applies. He does not turn a difference of opinion into public messages or interrupt care based on this guide. An urgent need should be addressed through the appropriate clinical services.

Prepare support without making a medical decision

Keep information about the operation, communications and replies privately. Share medical records only with appropriate recipients through the indicated channel. The intermediary can help organise the insurance enquiry; it does not replace clinical decisions or the procedure for resolving disagreements.

For an accident that has already occurred, use Policy support and claims with the existing case reference. A Work accident quotation concerns future protection; it does not choose a surgeon or confirm this operation’s expenses. Clara leaves Tiago four practical points.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Ask for clinical clarification of the proposed operation.
  • Separate choosing the surgeon from follow-up by the attending doctor.
  • Request steps for exercising the right and addressing any disagreement.
  • Retain replies and documents within the private process.
