Work accident: is there support for adapting your home?

Tiago Faria wants to know whether changes needed at home after a work accident belong in the same account as workplace adaptation. In this fictional story about an employee, Clara Mota separates the two enquiries. A planned expense is neither works approval nor a confirmed payment.

THE ESSENTIALS

Before you start

  • The need to adapt the home relates to permanent incapacity.
  • The benefit is capped; it is not an unrestricted renovation budget.
  • Confirm the applicable basis and document expenses in the case.

A specific benefit with a defined condition

Article 68 of Portuguese Law 98/2009 provides for home adaptation expenses needed because of permanent incapacity for work. The cap is 12 × 1.1 × the IAS at the accident date. IAS is Portugal’s social support index. Article 47 classifies this as a one-off benefit.

Adapting a home is different from adapting a job

Tiago prepares two sheets: one describes the difficulty at home; the other lists questions about returning to maintenance duties. Clara reminds him that a reply about the job does not confirm how the housing expense will be treated. Do not combine everything in a generic works invoice or treat authorisation for another purpose as approval of this enquiry.

Before commissioning work in reliance on reimbursement, establish which need is documented, what intervention is proposed and what has actually been confirmed in the case. A quotation helps frame questions; it does not replace a decision on eligibility or the amount payable.

The enquiry year does not select the reference

When checking the calculation, note the accident date and ask which IAS reference and limit were used. Do not automatically use a figure found for the year in which you make the enquiry. This guide does not calculate an individual benefit and does not address the separate occupational disease regime.

Separate quotations, invoices, proof of payment and replies rather than treating them as equivalent documents. If you have already incurred an expense, describe it accurately. For uncertainty or disagreement, seek clarification through the case process and appropriate professional guidance. Do not post medical information or private photographs of the home on social media.

Use the route that fits your need

For an accident that has already occurred, use Support and claims with the policy reference and a specific question. Clara helps Tiago organise facts without assessing incapacity, choosing works or promising payment. To compare future protection for the activity, select Work accidents under Request a quote; a new contract does not retrospectively fund this case.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Separate housing adaptation from workplace adaptation.
  • Identify the documented need and proposed intervention.
  • Check the accident date, IAS reference and explained limit.
  • Keep expenses and replies in the private case record.
